Declaring neighbour noise when selling

  • Thank you all for your insights, however
  • I guess my logic tells me not to mention it, rather like not mentioning past planning works that have already been carried out. Wasn't sure on the legalities relating to the question though.

The Freeholder will get a form to fill out from the solicitor when you sell as well. This happened when I sold mine. Its asks a similar question about complaints and disputes from residents in the block. Best not to contradict what they put on the form!
  • I can't see any problem here. I've had neighbour problems here - and know that, if I came to sell it, I'd have to put words to effect of "Neighbours used to be a problem in the following ways - but haven't been creating problems for some time now thankfully".

Your neighbours are totally gone - so I don't think there'd be undue concern if you said nothing at all about those ex-neighbours (precisely because they are EX-neighbours and couldnt create problems for you again if they wanted to). In your position - I'd probably say "There was a household that used to create problem with noise - but they moved 2 years ago and there've been none since then". I wouldnt be at all concerned as a prospective buyer about a response like that.

If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales
  • Yes. Even though it was resolved it's best to make a note of it. It shouldn't affect the sale as it is a past issue, not a current one.
