Witness statement from AM Parking.

I received a parking charge notice in November 2014 and following some bad advice from an online company who deal with getting the notices cancelled, I ignored them, but kept every letter AM Parking sent me.
To cut a long story short, I'm supposed to be going to court this month. The company owners witness statement signed by him, was emailed to me by Gladstones last week, with "copies" of all the letters they have supposedly sent me since the notice was issued.
The thing that has caught my attention was that when I compared them to the original letters I've received, four of the ones in his witness statement have discrepancies like;

- completely different wording and paragraphs added.
- letters dated the same, but have been signed by different people.
- stating the parking incident was caught by ANPR, when it was a notice on the window.

There are quite a few other things raising concern, but what I think is happening is the lovely people at AM Parking are assuming, as I haven't made any contact with them (as advised!!) I would of just binned all the letters from them, meaning they can just include anything they wanted in the statement.
What I want to know is, how would this stand up in court as it seems they are falsifying letters that they supposedly sent me to make them selves look better. Also, would it be worth bringing this to the attention of British Parking Association as AM Parking are members and have to comply with the BPA code of practice.

    Just checking you are not someone who thinks after the defence ages ago, you just appear at the hearing.

    Either way, read post #2 of 'NEWBIES READ THESE FAQS FIRST' about WS and skeleton argument stage (which is where you are now, the latter being your chance to tear into their WS & evidence).

    Show us their evidence & statement and tell us which court and what date hearing?

    I have put it all in my statement I have sent to the court, and I also included pictures of my original letters and their copies, I've also pointed out the discrepancies between them. I don't know if it will make a difference to the outcome, but surely they can't make up their own copies and submit them as the original documents in court?!!
  • It goes directly as to credibility. Assuming the particulars are as poor as ever, their whole case is set out in a statement that contains inconsistencies (albeit I don't know how material from the limited info available)

    I'd fancy you had a good chance of making a powerful submission that nothing goes the Claimant now says can be accepted and, if not, they have failed to discharge the burden of proof.

    No, they cannot, and this is where your skeleton argument comes in because you need to focus the Judge on these issues.

    Sorry, I'm new to all this, can I post their WS without jeopardising the case? If I can, I will have to spend a bit of time blanking out all my personal details as there are four letters in question. To give you an idea of what I'm talking about, one to their copies is dated 07/05/2015 and they are quoting a Supreme Court decision about parking charges in November of 2015, so it would appear they can predict the future!! 🤔 I will get this done tomorrow and post it all!! Really appreciating all the advice tonight, so thank you all. Also would it be worth me calling the BPA and voicing my concerns to them, or would it have no benefit?

    Just double check before posting that all personal data is removed.

    Made that myself on another issue. Thought everything had been deleted and after posting spotted some personal data.

    If you have nowhere to upload your picture then use tinypic.com or photobucket etc.

    Are they talking about the Supreme Court final decision or the Court of Appeal stage in Beavis, which was earlier?
    Also would it be worth me calling the BPA and voicing my concerns to them, or would it have no benefit?
    Pointless, they don't appear to care, they fob off consumer complaints and phoning the jumped up 'Trade Body' which merely support PPCs and pays lip service to the rights of motorists, is the last thing you'd want to do.

    BPA membership is not big or clever and means nothing at all; they are not regulators. Waste of time.
