Parking eye overstay

hi, i recently had a fine come through from parking eye issuing a fine of £50 that would increase to £85 if not paid the day i received the letter.
The problem was that i had a duration of 4h 16 minutes according to there system but only had paid for 4. This was mainly due to the fact that unfrotunalty I didnt have enough change and 2 of the three ticket machines were out of action. So after i bought 4 hours I had returned to my car before the time was up, by about 2 minutes and though I was okay., however they dont seem to take parking, paying for the ticket and then exiting into account.
not sure how to go forward with the appeal considering I actually did pay them to stay there!
any help would be greatful!

    And that is one of the potent appeal points you will make in due course when you appeal to POPLA - but that's a little way ahead.

    First, you must read the NEWBIES FAQ sticky, post #1 will do for now, and make your initial appeal to PE, using the already written template contained in that post.

    You haven't said what type of car park this was - retail park, hospital, hotel, - but often a complaint to the main occupier can see these tickets cancelled. Have you tried this?

    By the way, this is most certainly not a 'fine'; it is a mere speculative invoice, but it needs to be dealt with properly. Do not use the term 'fine' again, or you will find regular advisers getting a bit irritated! :)

    Read the NEWBIES thread. Use the template first appeal for BPA members, online.

    In readiness for POPLA, read other PE POPLA appeals about small overstays/ grace periods. Loads of examples on here.

    Hi
    I have just received a notice to keeper from Parking Eye for a stay at a car park in Newquay in Cornwall. The notice informed me that I had stayed in the car park for 2hrs and 1 minute whilst only paying for 2hrs parking. Parking eye noted that I entered the car park at 11:00 and left at 13:01. I have a ticket that starts at 11:07. There was a queue at the machine and also had to explain to a Spanish family about how to use the machine which took further time. As far as I am concerned I left 6 minutes prior to the ticket expiring and had no intention of exceeding the stay I paid for.


    I am about to appeal using the letter as described in the NEWBIES post, but was wondering if I should include the above or wait to see if this goes to POPLA? Thanks in advance.

    Depends if your PCN was received within 14 days and has the words about 'keeper liability after 29 days'. Or not. Start your own new thread please.

    Thankyou, I shall read the newbies thread and go from there.

    It was a retail carpark and is rather large so it takes about ten mins to park and pay on a good day.

    which in theory you are allowed in the BPA CoP as the first grace period of two

    the second grace period is to allow the driver OVER 10 minutes to depart after the parking event finishes

    Have you attempted to source who the major occupier is (or managing agent if a really large car park)? Is there a Morrisons on site, or an Aldi?

    Complaints in that direction, coupled with proof of being a genuine customer can often see PE cancel the charge. So work for you to do in that direction!
