Hi can I have some advice please , I was paying my debts through step change and through difficult personal circumstances didn't complete a review and they stopped making payments so my payment in kept being returned.
Anyway one creditor has served court papers and I'd like to know if I fill out the papers and make an arrangement will it prevent a CCJ or is a CCJ registered anyway as papers have been served.
Many thanks

I'm not an expert but I think you have time if you respond to prevent it , sourcrates will know!0

The only easy way now to avoid the CCJ is to pay it in full within 28 days from the date on the claim form. A payment arrangement can be agreed with the court's permission but you'll still have the CCJ recorded for 6 years.0

Thankyou , it seem really unfair to have default registered and them 6yr CCJ, you can ncver get clear of debts. That will be on my credit file for circa 12 yes then .0

Is it a county court claim form you have received ?
or is it a letter before action ?
If its a claim, you have 14 days to acknowledge service, if you go online and do this, you get a total of 28 days.

What is really unfair is not honouring your agreement you signed up to and then not honouring the one that Stepchange, a charity, spent time and money negotiating and administering for you.
You can get clear of debts and one thing CCJs do is stop you being able to borrow money you can't afford which only makes things worse.
Given Stepchange returned your payments then use the money you've built up as a result of those returned payments to pay the amount owed on the papers or offer to make a significant payment if they'll suspend the CCJ application. This is a system account and does not represent a real person.
