Insurance Advice Please
My daughter was in a private car park this morning. It was manned and the person on duty directed her to a parking space. He was guiding her into the space when she heard a noise and a metal pole had dug into the passenger side of her car, damaging the front wing and the passenger door. Her partner went there after the incident and the car park attendant had wrapped warning tape around the pole and put a barrier around it so it was very visible.
Does my daughter have a claim on the owners of the car park or the car park attendant? Or is it just bad luck and she will have to foot the bill?

If she can provide evidence they were negligent in their action yes, she has a claim.
She would probably need to show they knew of the risk and did nothing about it.
However from what you say, maybe that was the first time they were aware of the hazard and have taken immediate action.0 -
Could have been they were guiding her backwards not a lookout for obstructions. Just being helpful saying back a bit a bit more..
Marking the pole after because she probably damaged it and pushed it over slightly which is now causing an issue for the bay next to it.
She needs to be more aware of her surroundings. Always scan out the parking bay no matter where it is. Could be a post that is below the window line or it coulc be broken glass littering the bay.
I was waiting to enter a multistorey and queued up. Seemed strange, not normally a queue, single entrance opens to 3 barriers inside so to be queued all the way down would only happen at xmas peak shopping time.
Turns out it was some olg guy in a Fiesta who failed to spot the 4ft wall that swept all they way up the driveway entrance.

Thanks, yes I agree she should have taken more responsibility. The Car Park does not have marked out bays, it is on the land of a local museum. It is an odd shaped piece of land which is next to an old disused railway so the attendant just tries to get cars in where he can. Looking at the photograph, it is more a metal girder than a pole so I don't think she could have moved it. It was below the window line. Just wondering if it is worth going back there today? And if so what questions should I ask? When she went back to her car later there was a note on it off the attendant saying he had reported it to his boss and his boss would be in touch. Any advice greatly appreciated.0
