Probate Question

Hi, I'm new to this site, my mum died in 2015 and her will left everything to my father, I was looking after my father, who had Dementia. I closed her bank accounts and moved the contents to my fathers current account. She also had some money invested, they informed me I needed probate to move that money, because I was busy caring for my father, I never applied for probate (so just left it). (I also did nothing about the house as it went to my dad). My father died recently and I as executer of the will now need to sort the finances. The question is, do I apply for probate for my mother now as though my father is still alive and if so do I apply as though the money was still in her account, ie before I transferred it to my dad's. Thanks

    You will have to go through 2 lots of probate as you will not be able to release your mother's envestments without doing so. Those assets will also need to be declared on your father's IHT205 / 240 forms.
  • I am in a similar situation however I did get probate for the first parent who died, so that even though the estate had not been fully transferred to the second parent before the second parent died, it is now all being treated as the second parent's estate. So, it sounds like you do need to get probate for the first parent. I think it may be useful to approach Alzheimer's Society helpline, or Age UK, or Citizens Advice Bureau to see if they can help.
