New ccj from a debt in 2009/10

Hi ... can anyone advise me ;
After utilising Clearscore I have found a ccj placed on my file in past 2 months for british gas debt in 2009 / early 2010.
The date on ccj is august 2016.
I have lived at my address for 3 years and previous to that an address for 8 yrs.
The debt is from a short term rented property after i had to move due to fire damage . The tenancy was from sept 2009 to march 2010.
I have never recieved any paperwork relating to this debt.
Can i do anything about it ? Can they get a ccj for a 7 yr old gas debt ? How do i find details of it ?
Advice would be much appreciated thankyou !

    Yes, they can get a CCJ in default if you don't respond.


    You can apply for what's called a Set-Aside. Clearscore should have a Judgement Number/Court of Judgement and you can apply there. It'll cost £255 to apply but that can be mitigated in some circumstances.


    If the debt was statute barred (6 Years without payment or acknowledgement) you'll need to use that to get it set aside and then to the DCA to make sure they don't try again as a Set-Aside merely starts the process again rather than making any judgment.


    Remember that it is your duty to tell creditors, including energy companies of any change of address, so if you moved and didn't tell BG, the DCA would have served court papers to that address.

    Thankyou! The address actually was a "safe" house (fire/ arson) hence why i never got any paperwork im guessing .
    I have never had any contact with them so I think it will be worth acting ..even if it does start process again... im guessing i will have the chance to pay it?

    It still should've came through, but I'm not sure how these things work. You definitely were responsible for energy while you were at this place? If so BG should've sent at least letters to "The occupier" which you then respond to say you're the present user of energy.


    Either way, if you can get a set aside yes, you can pay any dues but if it's statute barred there no legal enforcement behind the debt so they wouldn't be able to chase you.


    Find the CCJ, take it to your local CAB along with the details behind the move etc and get some advice.
