any leagal people out there?

im wondering if anyone could give me some advice please and didnt know were else to put this so please move it if its in the wrong place.

the story is i went to comet today and while we were looking round my little boy picked up an open tub of fridge cleaner that had been leftt lying around and managed to spray it in his eye. i went to the desk to ask for a tissue and complain about someones negligence and told them i would be complaining about this as it should not have been left lying round for a child to pick up.
they rung A&E and they said we should take him there. when the doctor saw him and saw what hed sprayed he said hes been very lucky hes not been blinded.

i just wondered where i stood legally with this if i dont get the adequate response from comet. Of course im glad my little boy is fine but the principle is he could well have been hurt badly and this could easily happen to someone elses child.

comet obviously knew they were in trouble as all kinds of panic ensued when they saw what he had sprayed in his eye.

thanks in advance
pauline

  • So your kid is ok with no lasting damage - shouldn't that be your priority right now.
To be shouting about complaining BEFORE he got to hospital is out of order.

Take responsibility for your own action he was YOUR child and YOUR responsibility wherever you decided to take him.

Just be glad he's ok and not make a profit out of the situation.

To answer your question no doubt there are ambulance chaser solicitor firms out there who may take your case on with a no win no fee basis.

why was i out of order to say i was going to complain about chemicals being left around?
i do take responsibility for my child and you have no right to judge my parenting skills. And i did say i was glad he was ok but it still doesnt excuse leaving harmful chemicals around for anyones child to get hold of. i would like to have seen your reaction if it was your child.
he was actually very close to me and id turned my back for one secound to look at something so dont judge me. im njot an ambulance chaser and dont want any profit from this just to stop it happening to someone elses child who knows it might be more serious next time.
God iu expected more from this site than some judgmental person thinking they know it all

    Pauline,
What more of a responce do you want? Comet will clearly not leave such chemicals around again.
I suggest you either write to their complaints department, sue them through a solicitor or tell the newspapers. Either way I think you will get a satisfactory outcome.

I'm glad your little boy is okay.

Someone made a mistake and left a bottle around, maybe it wasnt brillant and ideally they wouldnt have but you let your child do it, and your child did it

    What do you want?

    People sacked? Money

Personally I agree with the repsonse you received, you clearly have to accept your share of the blame and stop trying to pass the buck

Maybe "comet" weren't thinking of themselves being "in trouble" but were rather concerned that your child could be in trouble because of what happened. Perhaps the "panic" was because of their concern for your child, not the repercussions on themselves. Maybe they were being nice people!

yes i really stood there and let my child spray harmful chemicals in his eyes. that makes perfect sense doesnt it.
obviously none of you have children or have ever taken your eyes of them for one secound. the only mistake i made was to look at something on a shop shelf.

NO i dont want money or anyone sacked but an apology that someone did something that resulted in my son getting hurt. he actually is now on medication for a reaction to this.

Do NOT JUDGE MY PARENTING I AM A VERY GOOD MUM AND DO EVERYTHING IN MY POWER TO STOP MY CHILD GETTING HURT.

lets hope none of your children ever hav an accident that you could not have prevented.

seriously stop judging if you cant answer the origanal question. i am not a bad parent and i simply took my eye of him for a second i dont expect to then have him spray chemicals in his eyes that should not have been left lying around. take a look at health and saftey and what it says about this.

Children have accidents yes, but their parents dont run off trying to apportion blame

You took your child into a hazardous environment then gave them the freedom to harm themselves

Your to blame, not the shop

Im sure they didnt think that someone would allow their children to start running riot or touching what they shouldnt
  • A second is one second too long!
I have kids and yes I take them shopping with me - I tell them not to touch things but kids being kids they sometimes try.

Your first post said he was now fine but by post 7 he is now on medication to a reaction - well what is it?

I never called you a bad parent but to get an apology from Comet you certainly do not need legal advice.
You write to their registered address which will be on every piece of paper in the store or online.

What exactly is the 'adequate response' you are looking for?

Believe me I don't know the half of it let alone know it all but from the replies here may I respectfully suggest that you are in the minority view here.

my child was not running riot and being allowed to mess about and he had been old not to touch like he always is. i did not give him the freedom to hurt himself. i did not run of trying to apprtion blame but i also did not take hhoim into a hazordous shop it was comet for god sake. what am i ment to do not go shopping untill hes 16. he chemicals should not have been left lying around they should be stored saftley.

He is fine in respect that he is not blind like the doctor said but he is on medication for an elergic reaction.

i cant have eyes in the back of my head and sometimes have to take my eyes of him or id never go into a shop.

i did not need this scrutinising just an answer to a question ejones yes you have never accused me of being a bad parent but others have in there posts ie saying he was running riot. actually he was walking around with me and simply picked something up when i looked at something. he was being very well behaved not that i have to explain my childs actions to people on here.

I think everyone is being a little unkind here. I presume that what Pauline wants (and she is probably acting this way out of shock and fear as to what might have happened to her child) is some reassurance that there won't be a reoccurrance of this incident.

What you really need Pauline, is to cool off for a couple of days and think about the outcome that you want. Then pen a letter, but don't send until you have read, slept on it, and read it again. Outline what happened, (they should have completed an accident report) and ask about their procedures for storage and use of hazardous cleaning chemicals. Stress that you want reassurance that they have changed their procedures and it won' t happen again. I am sure they will respond.

If the issue of compensation is in your mind, you won't get much if there was no damage other than some upset, so maybe not worth the trouble. Your child probably won't want to be examined in months to come, and asked questions about the incident, so maybe not a good idea.

Parenting is not an easy job, in fact the hardest job in the world, and I am sure you have enough of a guilty concience without being reminded. My daughter fell and broke her arm, just in the garden. You can't have eyes in the back of your head, and constant concentration. This does not make you a bad parent. At least you care.

I think everyone should member that you are all here for help and support not judgement.
