Car accident, possibly court.

Hi, I wasn't sure where to post this but..
I had a car accident end of last year, I was driving forward on a straight road and someone pulled out of a side road into the side of me, they caused a lot of damage and my car was a total loss. I had a witness who confirmed it was the other drivers fault. My insurance and her insurance agreed it was her fault and I had a payout for my car.
I was injured, so I have made a personal injury claim, accept it's looking like her insurance want me to accept 50/50! I will not be accepting that, so I'm guessing we will end up in court!
The other driver has lied through her teeth, I have a witness though but I'm still scared and don't know what to expect! Has anyone had similar experience. Thanks

Hi,
I had an accident in 2012 where a lady drove into an entryway that was behind me and hit the back of my car (I was parked). They refused to accept responsibility and it ended up going to court. I was scared in the run up but you've just got to remember that you're just stating true facts, backed up by evidence in the form of photos etc and actually I was really relaxed once I was in the 'witness box'. I had witnesses who, when it came to it, said they didn't want to go to court, which I believe is quite common so be prepared for that.
Anyway I won, the judge actually wiped the floor with the other party. Good luck, I'm sure you'll be fine

I am guessing her insurance has said they would deal with your claim on a with our prejudice basis, as her solicitors are still pursuing you.
I usually find that after we give notice of issuing, they tend to admit liability / drop the claim.
I'm intrigued as to what the third parties version of events are here though.0
