Accident compensation

Hi every one,

I had an accident while stationary a few years ago, I was hit from behind by a driver who had fallen asleep driving home from a night shift.
Last year I kept complaining as nothing was being done with my claim, no one contacted me about my complaints. Eventually I had an email saying my case was now being dealt withby a manager, she was appaled nothing had been done on my case ( no suprise)
I have been more than happy as she sorted it and got an offer from the drivers insurance company. This was sent via email to me but nothing from the other insurance in writing.

Since then I was told I would recoeve my payment in 2 weeks. Well on the 4th week I contacted my insurance, who then said they are writing to them and goving them 28 days. So 4 weeks later I phoned and no payment, the handler was on holiday for another 2 weeks. So again 3 weeks later I phone, we are now going toapply to the court for a judgement, but first we will give them 7 days to pay.
4 weeks later I phoned and the handler was off, some one else was dealing with it and have just sent off papersto the court, they were quite ride to me.
I phoned 2 weeks later, the handler said the judgement was granted 10 days ago. I was then told he would phone me back in 30 minutes, he was going to phone the court. Well time came and went, so didanother 2 days, no phone call.

I sent an email of complaint to the solicitor who dealt with my claim. I asked for copies of paperwork of the offer made fom the other insurance. I got a reply they are chasing the payment, still no copies of paperwork.
Ive asked the handler via phone for coppies of the pffer and copies of the court paperwork or to have in writing what procedures they are undertaking. Still nothing in writing!

I cannot understand why they offered me a sum but havnt paid even with a court judgement, now its down to the sheriffs. It is a known insurer.

I wonderd if it was infact my own insurance and they have had the money and they have kept it for interest. I cant uderstand why I have not had copies of the offer or procedures they are going through in writing. Why they havnt enforced the judgement as it has gone pat the deadline a few weeks ago.

Can I contact the insurnce company that made the offer to find out their side of things?

Any advice please

    It's unlikely that the other insurer will talk to you as you have no contractual relationship with them. I think you need to pursue this as a complaint with your insurer, following up with the FOS if necessary.

    One thing you could do is make a Subject Access Request for all information relating to you help by your insurer (maximum charge £10). There should be something on the insurer's website to tell you how to do this.
