Thank you everyone for your thoughts and opinions on this.

I'm not trying to dispute blame at all - the problem was it was a lot worse than I was expecting hence why I didn't slow down even further.

I've been driving 4 years without incident and I've never slowed down to walking pace in any similar situations and never had any problems.

Yes the road was signposted but in all honestly I knew what the signs were telling me anyway - I just didn't expect it to be quite so bad.

I think I will write to the council anyway, I'm convinced I can't be the only one this bit of road has caused a problem for and hopefully if a few people have wrote in it strengthens my case, or I may get a goodwill gesture.

If I don't get anything then that's fine I'll just out it down as a lesson learned!

Once again thanks for everyone's help and AdrianC, do you always sound so condescending?

    Yes. Yes he does.

Out of interest what car do you drive. There was an item on watchdog a while back about BMW alloy wheels cracking due to super skinny tyres.

Only where the situation deserves it as richly as this one.

A tyre should be able to withstand driving over that cover, was it inflated correctly?

My short question is this - do the council or whoever was doing the roadworks have a duty of care to ensure the road is roadworthy at all times? There are no signs up or anything. Is it worth writing to the council about this? Am I likely to get anything back? Or should I just write it off?

in your first post you said there were no signs up and then when you went back you took pictures of the roadworks signs including one warning of raised ironworks

then you mention "by the time the car infront has cleared it you have very little time to react safely" you then went on to say "I'm not even fully sure if I was behind a car at the time"

all of this would suggest that you weren't paying attention to what was going on around you, was there also a temporary speed limit in place as this type of works often has 10 MPH signs to keep speeds down due to the condition of the surface

if you feel that you have a claim then contact the council and see what they have to say regarding this, and in future pay a little more attention to what is going on around you when passing through temporary roadworks

If the OP was to declare all of that in court, I suspect he'd lose the case due to his own negligence...

Young inexperienced driver drives sports edition Fiesta making them gods gift in the local McDonalds car park meet, doesn't slow down when appropriate and tailgates vehicle in front, comes a cropper as to be expected and then still doesn't think it's their fault.

There's a ditch/tree/lampost with your name on it and it won't be long before you end up in it or wrapped around it.
