Is anyone really going to miss the six inch strip of garden they now have a fence on?

Not in the general run of things but it can make a difference if, say, there are plans for an extension in the future.

If the OP does end up putting up a second fence, it's worth staggering the fence posts so that they are halfway down and very close to the old panels - that means that only a couple of inches of garden gets lost and it probably won't matter if it ends up as the boundary marker.

Hi Everyone, Yesterday my neighbours try to fix the fence. The contractor came and they take out old fence and start installing new fence from the rear of the garden. Now I have metal rod installed in my boundary touching to his fence which clearly advice by my wife to contractors before they start installing fences. Now they started work and installing fence from out boundary. My wife shows pictures and tells them about wrong installation. The contractor denied any wrong work and said it is boundary issue and I have to talk with the agency. I email agency with pictures and try to explain the situation. The agency said it is boundary issue and they will speak with the owner of my neighbour. I ask them to give me owner's contact details so I can call and speak with the owner direct. But they are not providing that information. Not sure what next I can do about this situation. As they start installing fence from my boundary I cannot put my own fence. Any advice, please. Thank you

    You don't want much!.

I paid £2000 to have both sides and back of our garden re-fenced, you should be happy they're putting one up at all..

So the fence is being installed on your side of the boundary, yes?

    1) instruct the contractor to stop trespassing.

    2) start removing the suporting posts which are on your land - the contractor will soon get the message and stop work. Write to the owner (c/o next door, and the agent) asking him to give you a ring so you can invite him round for tea and cake, and to discuss/resolve the matter.

Some of the comments in this thread are a little bit unfair to the OP.

If (that's a big if) the neighbouring property has been sold with an obligation to provide and maintain a fence on the boundary then the OP is well within his rights to expect the neighbour to provide and maintain an appropriate fence on the boundary.

If there is no fence, or a fence in the wrong place, then the OP may have a headache to deal with when he comes to sell his property - nobody in their right mind (or a mortgage company) will buy a property where the boundaries may be in dispute.

Also, if you are the owner of a fence or wall on a property boundary then the obligation to maintain it is very important and shouldn't be neglected. If a fence, and especially a wall, collapses due to a lack of maintenance then at best you could be looking at the costs of making good damage caused to neighbouring property - at worst you could find yourself facing a manslaughter charge. Not something to be taken lightly.

The fencing contractors don't want to redo what they have put in the wrong place so you will need to be firm with them. It's trespass and they need to move the posts. Do persist and get the owners contact details OP.

If they are absolutely on your side, in your garden, I'd personally heave them out and throw them into their garden. But I have the tools and don't care about what a neighbour might think.

Well. The fence was fallen down in 6 Febuary 2017 so I waited patiently till date. As my neighbour are renting they don't care about the fence if the fence was on my side or his side. I really want to resolve this issue with mutual understanding. I will email agency again on Monday if I can talk with the owner of the property. I am sure even owner don't know where the old fence was. It is clearly fence company's mistake. I send old and new fence images to agency anyway on the same day.

    1) Yes I did. They stop the work.
    2) Thank you I will do this today. Thank you.

It is clearly contractor mistake. Before they start to do work my wife already inform them. I am not sure how they define the boundary, but very first post they installed from the very rear of the garden than from that point they take a thread and expand toward the house. I am sure owner of the next door property even don't know where is the old fence was. They should start installing new fence where they took the old fence.
