So why, in this case, dont they prosecute the registered keeper of the car if he or she cannot provide reasonable evidence that they were elewhere at the time of the incident?
Because, except in a few very serious cases like speeding, people are still innocent until proved guilty in this country. Which means the RK doesn't have to prove squat, it's for the prosecution to prove he was driving. If they can't do that then the case fails.0 -

It's just that they have the choice to accept their guilt and a fixed penalty rather than go to court. If you wish to plead not guilty, you can choose to refuse the fixed penalty and go to court, where you will be innocent until proven guilty, and all the usual rules of evidence apply.0 -

I can't help that FACT that driving these cars gives the driver a an overinflated sense of self importance..... And whether it's in a car or out the local pub, these people get very short shrift from me......“I may not agree with you, but I will defend to the death your right to make an a** of yourself.”

Even then, they still are.

I was thinking more of the "we can't prove you were driving so we'll make it an offence for you not to incriminate yourself and charge you with that instead" rule.0 -

Yes I thought so too, but Audi drivers were saints compared to the BMW crowd on my 4 hour round trip to London. Not what I expected at all.“I may not agree with you, but I will defend to the death your right to make an a** of yourself.”
