C.A.R.S / Opos Limited

Hi, have been reading this site for years. But only just joined as i wanted to post what is going on with me and a Three mobile contract.

Last year i took a Sim only contract out with Three Mobile, the Sim never arrived, i kept asking for it to be re-sent, never did and as such i asked for the account to be closed, and asked my back to refund all the DD's i had paid under the Direct Debit Guarantee, as i was paying for something that i was unable to use.

My bank did refund it all, but Three closed my account with a early termination fee. I make a formal complaint, and then went to the Ombudsman. The Ombudsman found in favor of Three for some reason.

Three then passed the "debt" to the debt collection company C.A.R.S. (Creditlink Account Recovery Solutions Ltd). Who was actually really good. They sent me one letter, i replied via email explaining everything about the Sim card not arriving, not activating and all that stuff, they then replied saying they would close my account and send it back to Three.

A few weeks later Three then changed my mobile account on my credit file to a £0 balance and i guessed that must of been the end of it.

This morning i have had a email from Opos.........

"We refer to the balance owed to our client Three relating to an overdue bill. Three have advised that you should be aware of the outstanding amount which is shown to the right of this page.


Opos Limited is a specialist debt collection organisation and we have been instructed by Three to collect this balance owed. All future payments and communication must now be made direct to us unless we advise you otherwise.


Our client is not aware of a valid reason for your non-payment and the full amount outstanding should be paid immediately."

I'm going to reply, and include a copy of the letter from C.A.R.S saying they was unable to chase the debt and they passed it back to Three, and all Three have done is pass it onto them.

Just find all this funny.......wonder how long this run around will last.

    Hi,

    On the face of it you would think it would be a pretty straight forward case, why did the ombudsman side with 3 ?

    Did they give a reason ?

    How can you be expected to pay for a service you didn't receive ?

    Anyway, regarding the DCA, you may find this is one of a long line of debt collectors that this is passed to.

    Incompetence dosent really cover it !!!

    Ombudsman said due to Three offering to re-send the sim card (after 4 months of waiting) they said i should of accepted it and not closed the account. So sided with Three.

    It's a good job I can look on the funny side of this, some people would just pay the £80 to get it gone.

    Update, i made a complaint with Opos Limited and they replied saying the "Financial Ombudsman" has sided with Three, they will chase me for it still. I explained why would the Financial Ombudsman look into a case that's about a mobile network and had this email back from them today......

    "I have been made aware you have been in touch regarding your Final Response.
    Please note the original response from Three stated ‘Ombudsman’ and did not specify which, and as we mostly deal with the Financial Ombusdman, when I wrote your second Final Response I put ‘Financial’ in error. I apologise for this however you are aware of which Ombudsman you went to (and have admitted so) and you are aware your complaint was not upheld with them. As your second complaint was about your contact methods and has been shown to be not upheld either, the point in this still stand. You are liable for this balance and the account will reopen for collections activity. Please note you have updated your email and telephone number as ‘contactable’ on your last call with us – this will remain in this state unless requested otherwise.

    I replied with.....

    "I would like to make a 3rd complaint about the errors David *last name* has made in my first 2 complaints.

    I would also like to confirm yet again that i DO NOT wish for you to contact me by phone.


    I have given you proof this debt will not be paid when you first started to ask me to pay it, i have also asked you to take me to court for a CCJ so i can show the judge my proof."

    His reply....

    "We will not be upholding your complaint you have raised as you were responded to this in an appropriate manner.
    We will remove your phone numbers from contact, however as per the Final Response relating to contact, they may be reinstated if a resolution is not made on this account.

    As per your first Final Response, Three and an Ombudsman have not upheld your complaint and you are liable for this balance.

    His reply....

    "Your complaint was responded to and not upheld. You are aware you are liable for this amount and it will remain ongoing until resolved.

    "As i ALREADY sent you back in May 2017. Please see attached proof it is closed & settled with a £0 balance.

    This is why C.A.R.S. was unable to chase me for it, and they closed my account within the week and sent it back to Three saying no debt is due.


    It's amazing how one debt company can show me respect. But another, Opos, just treat me like something you walk in, and David *last name* does nothing but makes mistakes."

    He has not replied yet. But i wanted to keep this thread upto date, as i hate reading on here and we never find out what happened in the end!!! lol

    One last update......

    I started this thread in April when Opos took on an account and refused to close it, or accept anything I told them. But i stuck by my world. I replied to every email they sent me, replied to ever letter they sent, each time they called i asked them to delete my number, then the next time they called i opened a formal complaint. I made it clear they could not bully me.

    Well yesterday I have had the below email..........

    "Hello,
    Your account is now closed with Opos Limited and you will no longer hear from us regarding the matter. It has closed as disputed as we will no longer working on your account.

    It has now returned to Three and they will take further action of their choosing regarding this account. Please direct any future concerns to them.

    C.A.R.S closed my account and sent it back to Three Mobile within the week, Opos took 6 months......wonder what Three will do now? prob just send it to another DCA. But i don't mind!

    You probably hit the nail on the head there, it will just be farmed out to another DCA, then another, until they get tired.

    I once had an unenforceable debt chased by no less than 16 separate DCA`s, over a period of two years, eventually Cabot bought it, told them what i`d told the rest, closed the account within 24 hrs, not heard a whisper since 2008.
