Car potentially going to be written off

Hi,

I was involved in a RTC on Tuesday morning whilst on my way to work. An elderly chap in a Range Rover pulled out of a side street straight in front of me smashing into the off side of my 9 month old X1 throwing my vehicle onto an embankment and into some shrubbery. The driver of the Range Rover has admitted liability (he said he didn't look left) and Tesco (his insurance) up to now have been pretty good. I spoke to BMW yesterday and the value of the damage so far is nearing £13,000. I currently owe £25,000 on the finance of the car which I purchased for £34,000 in June last year. I don't have any Gap Insurance. The car is full spec M Sport (every add-on pack) and a service pack.

I spoke to Tesco this morning and they are waiting for one of their engineers to review the pictures and the value to deem whether its worthy of repair but the call handlers opinion is it likely will be written off.

Tesco have provided me with "loss of use payment" until Tuesday as I cannot drive due to my injuries . I am due to fly to Australia on Tuesday for two weeks. Whilst I am away I will still be paying for the finance on my car.

I was hoping someone could help with a few questions -

Should Tesco still be paying me for "loss of use" whilst I am away? and up to the date of decision.

If the car is written off, I am hoping that I will be given money once the finance is paid. Once that is completed is there any responsibility to provide me with transport? My only thought is getting some new wheels won't be a quick fix.

The car is immaculate and I've been told that along with the spec and add ons will be taken into consideration when valuing my car.

Never had to go through this before (and never want to again) so any advice re cars getting written off and the procedure is greatly appreciated.

    MASSIVELY unlikely to be written off, then, unless there's other damage which hasn't yet been taken into account.

    Well, at least the finance is almost certainly going to be settled if it is written off, so gap insurance is not going to be an issue. You won't come away with all of your other nine grand, of course, but then it's had a big chunk of depreciation.

    Why? You won't be losing any use from the car.

    No. If the car is written off, their liability stops. It's then your problem to replace the car. You could be driving a replacement that afternoon, if you so chose.

    Get GAP insurance next time. It's only a couple of hundred £££s
    You took out a loan to fund a fully loaded X1 but you're too cheap to buy GAP insurance? LOL

    Gap covers the shortfall on finance. There won't be one here.

    RTI cover may have proved a bit more worthwhile, though would still not be an issue, given how unlikely a £30k car is to be written off for £13k of damage.

    No. If the car is written off, their liability stops. It's then your problem to replace the car. You could be driving a replacement that afternoon, if you so chose.

    Was it a new car and do you have replacement car benefit on your own insurance?

    Yes it was a new car. I have a replacement car benefit. Tesco have paid me for loss of use but only until Tuesday.

    Why not claim on your own policy and if its written off you will get a new car.

    Many car insurance policies will replace the vehicle with a new one if written off in the first year, gap is a good idea yes and cheaper if taken out soon after the purchase but for the first year it's not always necessary

    The car is under a year old (as far as I can make out) therefore there is no need for gap insurance as the car would most probably be replaced.
