    We are thrilled for you, Sarahlou, and awaiting a full court report!

    If you don't mind also telling us in your 'report of the day' the claim number, which court and Judge, we can sometimes use a success like this to at least mention in other defences (despite each case turning on their own facts). It also helps us see which courts are good, or which Judges are possibly *bad*.

    Please do post a report of what happened and links to your defense / WS etc.
    It would be so useful to others on here who will go through what you have. Can't stress that last bit enough

    Hi Guys

    Im so sorry! Here goes - So as you know, my friend parked in a car park that as a community we have used for years and there are no signs in that part of the car park telling you you cannot park there. She then recieved a car parking fine which she ignored. This then followed with lots of threatening court letters etc until eventually Gladstones became involved. My friend panicked and offered to pay £5 a week although she stated she did not admit liability she just "wanted them to go away". Then the Court process started. We did exactly as the Directions asked us. They wanted a hearing there, we wanted it local and they wanted paper and we wanted an oral.... We ended up local and at Mansfield Magistrates Court for a oral hearing.

    We sent our defence is which was simply a letter to the Judge with photos taken of the car park and taken on the same day we sent it our defence which show there are no signs.

    Upon recieving our Defence, Gladstones sent theirs in.... What a joke

    Standard witness statement spouting lots of rubbish, an unsigned site plan showing dots where they say signs are (I could have drawn that), a picture of my friend in her car and they relied upon her admitting liability.

    They make it sound very believable so I can appreciate that at that point, people panic but please don't... Its laughable and shabby.

    We arrived at Court with no sign of anyone from Gladstones.

    A lovely lady came through to us and said " Mr Miles, I have some good news for you... The Judge has dismissed your case and will be telling their representative upon his arrival to stop wasting Court time" We were then given an Order for costs and were on our way :)

    If there is any where I can upload their defence to then please let me know and then at least you get an idea of what they are coming at you with as it appears to be a standard defence pack. Any questions ill pop on everyday to check -

    One thing I will say is to keep it personal, don't try and become a Lawyer overnight. Stick to the facts and dont try and use legal jargon - they stitch themselves up left right and centre - sit back and watch them lose xxx

    Thanks for that information. Two points:- it was never a "fine", and it would have been the County (civil) court and not the Magistrates court . But well done!
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    Thank you very much for the report. Pity you weren't with the judge when he tore into the Gladstones rep.

    Copies of their defence are easily hosted on a free hosting site like TinyPic, Photobucket, Google Dropbox (or the like). As a newbie you don't have 'live' linking privileges, so just simply copy the URL, paste it here, but change the http to read hxxp (which creates a 'dead' link) then one of the regulars will convert it back to 'live'.
