2nd house stamp duty

Need to know if I have pay 2nd house stamp duty, scenario is as follows......

> Purchased a house in 2015
> relocated to different part of country in 2016 and obtained consent to let
> let out house and moved into rented property in different part of country
> looking to buy a house in area I have relocated to as dont want to pay rent

Would this trigger 2nd house stamp duty? This will be my main residence and have no immediate intention to relocate back to original location.

    Will the property you wish to buy in the area in which you are currently renting, be in addition to the property you are currently letting out?

    If yes, it will be the 2nd property that you own and therefore you will be liable for the 2nd home stamp duty surcharge.
  • Yeah it will be in addition to the let out property.

    But hoped as it would be my main residence I could avoid paying 2nd house stamp duty. Plus the 1st house bought in 2015 was before the new legislation came in.

    Rather than hoping you could have tried searching the forum since this question comes up on an almost daily basis.

    1 + 1 = 2 ergo you will pay the additional SDLT.

    Are you selling a house you live in mainly to buy another, no.
    Are you buying a second house. yes.

    But you aren't selling your current main residence. It's an additional property. If you owned the place you were living in now, and were selling that, then it would be exempt. But you're currently living in rented.

    You are not disposing of your main residence, as you cannot, it is rented.

    You have one property now. Soon you will have two. Yes you have to pay then2nd home stamp duty.

    When you bought your old property doesn't matter at all. You could have bought it in 1970 for all they care.
