SMART parking Ltd Fine Fistral Beach

Good Afternoon All,
I just received a PCN from Smart Parking for an overstay at Fistral Beach yesterday.

I drove into the car park at 1030 am and was caught on ANPR. Parked up and bought a 1 hour ticket at 1040 (10 minutes after entering). Returned to my vehicle later and was again snapped on camera leaving at 1148 (8 minutes after the ticket expired). I want to submit the appeal but I did not keep the ticket(It's been more than one week).

I want to appeal like this ;

-This was paid for within the 10 minutes stipulated by your signs in the car park and the vehicle left within the 10 minutes set out by the BPA once the ticket expired.
-The fine is a bit too much for just a few minutes extra.

But my problem is I didn't have any proof of ticket. Anyone can help me? can I ask them to check the timing of my payment as a proof of I paid the ticket.

Many thanks.

    use the blue text BPA template from the NEWBIES sticky thread

    add an extra note stating that the BPA CoP applies, clause #13 , grace periods

    do not reveal who was driving

    it is not a "fine" it is an invoice

    whatever you think about the amount , the SUPREME COURT ruled in the BEAVIS case over 16 months ago that £85 was not unreasonable , so that argument wont wash

    There are loads of Fistral/Smart cases. Do a forum search using search term 'Fistral Smart' and read how other recent cases progressed. Learn how these were dealt with, then formulate your own plan of attack - check it out with us to make sure it's 'on target'.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
