Gladstones - Directions Questionnaire

I've recently received Gladstones directions questionnaire, requesting that my case be dealt with 'on the papers'.

I realise this is a common ruse by Gladstones.

Obviously I do NOT want the case to be dealt with on papers alone. What do I respond? Do I have to respond to the paperwork they have sent me? There is a form at the back of their letter stating 'response to court' with the options of:

A - I agree the claim should be dealt with on the papers alone
B - I do not agree that the claim should be dealt with on the papers alone
C - I have sent a copy of this completed form to the other party.

What do I chose? Option B sounds like the most obvious. If I select option B, do I return these papers to Northampton Court or where?

Im a bit confused

I'm struggling to find 'the' answer to this anywhere...

Do I just ignore Gladstone's 'offer' to go on the papers alone or do I have to actually respond saying NO?

I'm still to receive my own directions questionnaire from Northampton, why have Gladstone's received and completed theirs before I have??

You have received the Claimant's copy from Gladstones, because they are acting for the Claimant, and are obliged to send you a copy. You will get a Defendant's copy soon, and you must send to back completed to both Northampton and Gladstones.

In the bit where it asks which court you want the hearing to be at, you put the name of your local court, and add the following:

The Defendant opposes the Claimant’s request for special directions, and requests that the case be listed for an oral hearing at the Defendant’s home court, pursuant to CPR 26.2A(3)

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

no idea why you are struggling because BARGEPOLE explains all of this in his posts that are linked in post #2 of the NEWBIES sticky thread, whish is the only post you need to read for now

bargepole has now put a summary above, but I suggest you read all of the wise words by CM and him in that post #2 as well

Search the forum for 'Gladstones straightforward'.

This is a chance to prepare a letter to send to the court with your completed DQ (when you get it from the court), same as you will find on the resulting threads from that search of those two keywords. I recall the latter was used by 'Jack basta' and by 'Gin and Milk' in their threads where this is fully discussed and their letter shown, hoping for the claim to be struck out (worth a try).
