Hi
I've tried reading the FAQ posts but I just get lost and can't follow what any of it means.
I've got a letter on the 17/4/17 from SCS asking for £170 from 2/10/16 at a matalan store
"paying a fee to park at the site for a specified period of time and subsequently overstaying this time or failing to pay a fee at all"
This is the first I've heard of this. I know the store and live in the area but never park there. (I don't shop at matalan)
It then goes on to talk about court and so on but no phone number just a payment line.
Is it a scam or real ? It's got no real contact information on it.
Thanks
John

You need resilience to get stuck into this stuff, with a determination to beat the PPC chasing you. A quick skim-read simply won't do that.
From your very vague description of what the correspondence says (or doesn't say) it's difficult to give you bespoke advice.
It sounds more like a debt collection letter than a Letter Before Claim, but if you can host it on TinyPic or Photobucket, copy the URL here (but change http to hxxp) then we can give you some more specific advice.
How did you get on with complaining to Matalan? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I'm afraid you've got some real problems then. Much of this is self-help, with some guidance from a small handful of regulars (not a case of just hand it over and leave it to someone else to deal with).

from memory matalan have booted smart out because of the way they treat customers , and I have read that even tho matalan ask smart to back down , they wont , mind you the OP might be the one to break smarts court "cherry"Save a Rachael

If it is a Letter before Claim then reply to it as registered keeper, denying liability because Smart Parking do not use compliant POFA wording and whilst you know the store and live in the area, you never park there and do not shop at Matalan, so it is certain that you were not driving.
Add that they have failed to state the facts of the case ("paying a fee to park at the site for a specified period of time and subsequently overstaying this time or failing to pay a fee at all" means nothing at all, far too generic, a robo-claim effort). But either way, as the keeper was not the driver, there is no cause of action.
Come back if they do try a claim. I think we've been told about ONE (if true) from SCS for Smart, where the OP reckons court papers have arrived. But not corroborated and no other cases have proceeded.
Defendable by a keeper so do not say who was driving and please re-read the NEWBIES thread post #2 only.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
