When retail has your money and doesnt supply item before 30 days

Options
OK, so I bought a watch on Zalando, they took the money straight away and I waited. 39 days later they cancelled the order. The watch was 80 quid and I used an £8 voucher. Sounds like nothing much, but Im hacked off as the watch was a gift, plus im on here to ask, can retailers take your money and keep it for that long without supplying the goods. I think they have 30 days? I asked for the voucher back and some compensation and they offered a small discount on next purchase and wont replace the voucher. Do I have any ammo to go back to them with ?

What was the voucher? Was it tied by date? Would it be valid anymore?

Any compensation you would get would be paltry to be honest. Then discount would probably be better.

It was simply a welcome voucher when I signed up, giving £8 off £75 spend. I thought they would be in breach of consumer rights having kept my money, and possibly many others (thus earning them interest) for a prolonged period.

How much interest do you think they earned on your £72 for 39 days?

Maybe they thought they could fulfill it and then had issues?

You've got your money back. You didn't expect to have that money you expected a watch, so you haven't 'lost' anything. You have your money back.

The voucher was a reward for buying from them so they won't be issuing you one as you haven't bought anything.
A discount on another order is the same result as you couldn't use the voucher anywhere else.

This appears to be a german company so any regulations that apply will be those in Germany.

If they had supplied the watch after 39 days would you be complaining about them having your money?

Did you complain about them having your money during that time?

Thanks for the replies. No they arent going to earn much from my £72, but if 10000 people bought a watch that would be a different matter. I thought there were consumer rules and perhaps I could negotiate a replacement with discount. I'll ring them and ask nicely for a replacement voucher. Nothing ventured.
