Did the judge agree with 'variation of contact' or dismiss it as not relevant. Would help us to know whether to mention this in the future.She also noted Jolley v Carmel0 -
The judge didn't express a view on "variation of contract" only that it was my defence. I guess she may have expressed her disagreement but not sure.
I think i found a reference to Jolley v Carmel on this forum, although can't remember in which thread (read so many).
I should be getting the formal notice from the Courts soon I guess and will update if there is any more information in it.0 -

She also noted Jolley v Carmel: a party who makes reasonable endeavours to comply should not be penalised when unable to fully comply.
Jolley v Carmel was used by bargepole in a similar defence he wrote for someone here (sadly that case was lost, a harsh Judge I think).
Anyway I liked the case too so I asked the BMPA to host it, a few months ago, and they have:
