    Did the judge agree with 'variation of contact' or dismiss it as not relevant. Would help us to know whether to mention this in the future.
    She also noted Jolley v Carmel
    That one's going in the napsack, not heard of that case before where did you find it?
  • The judge didn't express a view on "variation of contract" only that it was my defence. I guess she may have expressed her disagreement but not sure.

    I think i found a reference to Jolley v Carmel on this forum, although can't remember in which thread (read so many).

    I should be getting the formal notice from the Courts soon I guess and will update if there is any more information in it.

    I'm late coming to this, but just to say a belated 'Well done' and how well your report back was laid out, nice and clear tonread with key points highlighted.

    Excel stuffed once again. They should sack BWL who continue making a right pig's ear of things for them. On second thoughts, no, keep them on!

    She also noted Jolley v Carmel: a party who makes reasonable endeavours to comply should not be penalised when unable to fully comply.

    Jolley v Carmel was used by bargepole in a similar defence he wrote for someone here (sadly that case was lost, a harsh Judge I think).

    Anyway I liked the case too so I asked the BMPA to host it, a few months ago, and they have:
