Help! CCJ In my absence from cowboy parking company

Hi all, in desperate need of help as legal advice on this matter is sparse and I am chasing my tail.

On 6th April I came home to a welcoming sight of a card from DCBL. A high court enforcement officer had been to visit my rented accommodation searching for me. I followed this up with a phone call to the enforcement officer on 7th April, he explained to me that I had a CCJ passed on my name in October 2014 for unpaid parking fines, he explained unless I gave him some form of payment, he would be round to collect my things as payment. Instinctively very upset I gave him a begrudging £250 to avoid this happening so I could get to the bottom of what had happened:

On 29th March 2014 I moved into a property with regulated parking, it is on private land and requires the residents to display parking permits. These permits were not supplied to me moving in. It was agreed between my landlord and the management agency that any tickets I had (for parking in my own spot) would be recinded and as a result I heard nothing more.

It transpires that Park Direct UK Ltd issued 23 tickets to my vehicle over a short duration of time, prior to me receiving my permit. I received no letters following up these tickets so presumed rightly or wrongly they had been recinded upon agreement with my landlord. This was all verbally.

In October 2014 Park Direct UK Ltd issued a claim to Northampton County Court Business Centre for these tickets- they were successful, purely because Park Direct UK Ltd had taken it upon themselves to pull details from my logbook from the date I had moved in from DVLA obviously this being my previous address. All correspondence has been sent to my previous address and the CCJ has been passed there too.

Knowing I do not have any written confirmation from the management company nor my landlord about recinding these tickets, how do I now proceed? At the time of this judgement Park Direct UK Ltd were not part of the BPA or IPC. The fine now totals £3359.39. £1570 of this being from the CCJ itself, the rest bailiff fees which they have failed to give me a breakdown of or any other communication since taking my £250 on 7th April.

Any help on this matter is greatly appreciated.

    Apply for a set aside PDQ. Cost is £255 and you'll get a judge to look at the case again.

    23 tickets without engaging seems a bit ostrich like. Did you appeal at all?

  • The tickets were put on my car but I have had no paperwork hence no appeal.
    I trusted the information given by my landlord.
    I was advised not to submit a N244 unless I had all evidence in writing

    Did you get that in writing. And does it include a reference to his/her lease.

    Given the issue you have had with advice, who advised not to raise a request for a set-aside. Usually it is as soon as reasonable after you find out about it. Delays don't usually help.

    Just to add to IamEmanresu's excellent advice...the NEWBIES thread post #2 is all about court defences (which you will need to show has legs, as well as why the claim was not defended).

    Also there are a few links there about your options re a set aside. We will help advise you along the way. You need to make a very good case, with that money at stake.
