Student Housing Nuisance

Hi guys seeking some advice about what my rights are in this situation. (New here so sorry if this is in the wrong place).

Living in a student house with us all being on separate contracts, and I have a girl living below me who is always playing music. Now, the music doesn't bother me, but the bass does, because it's impossible to block out.

I've written to our landlord and they asked for proof which I provided, then they told me they'd informed her it was to stop. Fast forward two months and it's still going on and I've been in constant dispute with my landlord, who eventually said that there's nothing they can do and that it isn't in fact a problem.

Our contract states that people shouldn't cause a nuisance or annoyance to the landlord, adjoining properties or occupiers, and they have stated that since I am the only person to complain and they haven't received complaints from next door that there isn't an issue.

They state that since it is between 11 and 7 (a separate point in the contract) there isn't a problem, whilst also having confirmed it was an issue last month. I think it's been going on so long they're trying to backtrack, however I may just be in the wrong, and would appreciate any help on what I can do, if indeed I can do anything. :rotfl:

Do I have any rights here because I've paid a lot of rent to be here until July and I can't even study in my room, never mind sleep in it. :rotfl:

    Have you asked the person making the noise to come to your room so they can hear what it's like for themselves?

  • Yes I have she doesn't care, she is fully aware of it. :(

    Don't think she sees it as a problem, even though I asked her to keep it down, like I told her she can have her music on whenever, just turn of her bass.

    Ring up your local council's noise team they are the people who deal with nuisance noise. Ring them up and see if they will visit while the noise is going on. Also make a recording of the noise with a date and time on the recording.

    Hi, :) I already made some recordings though these were during the day when it was very loud, but my landlord says since its the day it isn't a problem. To be honest I was hoping to resolve it with my landlord but I'm afraid contacting the council will be all I can do at this point, and kind of scared in case they too tell me there's 'nothing they can do'.

    You say that you can't sleep in the property? Does this mean that it happens at night as well? If there is nothing that the council can do then it means that it isn't a noise nuisance it is just a problem noise for you. The council will have a level of noise that causes a nuisance.

    Do you have any hifi equipment you can crank up when she is trying to sleep?

    Yes it does but I like to sleep before my landlords threshold of '11' of being unacceptable hours. So it will be at night too just quieter.

    Would they be able to come out and measure this?

    I'd been trying to keep my nose clean during the dispute, but I fear this will be the only solution.
    I don't have anything of the sort but have considered it, though this is an expense I'd rather not take.

    Find out who her parents are and send a little email/make a phonecall. Yes even if she is in her 20's....see what they come up with. Embarrassment often works wonders.
