yes, this is already a court case, so the next stage you are currently at allocates the local court and judge , its a set of steps that the PPC has set in motion because THEY re in the driving seat , you are locked in the boot with limited means of escape , the destination is already predetermined, but the outcome isnt

what you want to do is not really relevant , the PPC have issued a court case against you and although they could pull out of it or fail to pay their next fee to take it to an actual hearing , its going ahead at the moment because it is their choice to make , not yours

any failures on your part could result in a default judgment against you and no ability to challenge the fees that may or will be added , which could increase your charges and you wont like that either

you really need to grow a pair and get a handle on this and start fighting back, or esle it will cost you dear

if you win you will owe nothing and can claim up to say £95 in fees and costs

if you lost in court , you pay what the judge determines in his/her judgment

ignoring is foolish , mediation does not work , fighting back is your best option

I am sure that fred talbot and stuart hall and rolf harris did not want to be taken to court either, but they had no choice in the matter and they got their just desserts (although those were criminal court cases, not civil ones)

Don't ignore this letter assuming it's from court!

If you do you can expect a ccj by default for the full amount of the claim plus any extra allowable costs the claimant has had since the original claim was issued. (Eg hearing fee)

From the information on the forum this means that my case will now be going to court...

Not necessarily. This is a really early stage of paperwork, that's all.

And almost no-one wants to go to court, except bargepole!

Personally, I think CEL are pushing these a tad further to see who blinks. Don't assume they want hearings against all these people with decent defences, because IMHO they won't. They are looking to scare you all, and pick up money from numpties who have copied a defence but can't hack it just because some more paperwork has arrived that makes them think a hearing is inevitable. It's not (but it's winnable - and no risk on your credit rating - if it progresses).

And don't worry. As long as the driver has never been identified, CEL can't hold you liable and you would likely win at any hearing anyway, except if your local court is a hopeless one about PPC scams, like Wigan has proved more than once in reports elsewhere.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
