Tablet with awful battery

Hello everyone,
I purchased an Nvidia Shield K1 tablet from ebuyer last November.
When i started using it, i was very disappointed with the battery life. It's claimed to be 10 hours on the literature, but it was listing about 5 and a half.
I contacted ebuyer to tell them about this issue, and to tell them that i was going on holiday until 24th of December, so wouldn't be able to return it to them until i got back, and that I'd see if it improved when i was away.
Once i got back it was still bad, so i contacted them again, and they told me to get a warranty replacement from Nvidia. I've since had 4 or 5 warranty replacements, all of which have performed worse than the original i had.
I contacted ebuyer again and told them this, and was told that they'd only be able to refund me if i got a letter from ebuyer saying that there was no way for them to resolve the issue.
I asked nvidia if they'd be able to provide this, and they told me they weren't able to.
I forwarded the transcript of this to ebuyer, and they told me they couldn't see where the person at Nvidia has said this, and have kind of backed out of their initial statement saying that if Nvidia said they weren't able to do anything else, then I'd get a refund.
I saw this link on pc advisor which says:
You should always return a defective product to the retailer, or wherever you bought it. Ideally the fault will appear in the first six months because the seller will need to prove that any faults that develop within the first six months are not due to a manufacturing problem. If they can't, they are obliged to give you a refund or a replacement.
I've asked Nvidia for a final replacement, and they've said that this is the last one they'll be able to send me.
Can anyone tell me if I've got a right to a refund from ebuyer?
The battery lasts about 4 and a half hours of usage, and if i put it down at night with say about 60% battery, it's drained itself by the next day.

Most, if not battery powered devices usually give an "up to" battery life as this time can vary hugely depending on how the device is set up and what applications are being run.0 -
Whether you would be due a refund or not would depend on why the battery is draining so fast. Screen brightness, apps running in the background, wifi/bluetooth being turned on....if it was due to any of those then probably not.
If it was due to the battery not being as described rather than the above then the law allows the retailer one attempt at a repair/replacement before you can insist on a refund. You could however argue that they have already had this one attempt when they instructed you to get a warranty replacement from nvidia since the warranty formed part of your contract of sale.
You need to be able to prove the goods don't conform to contract (since the party alleging breach of contract needs to evidence breach), then they need to prove the lack of conformity isnt inherent (as its within 6 months)You keep using that word. Amazon review/s say battery drains .
EBuyer reviews say poor battery life .
5 replacements more or less says it not a faulty battery .More like battery is under powered for the spec .

In terms of battery life, Nvidia is claiming you'll get 10 hours watching/surfing the web and about five hours from gaming with its 19.75 Wh battery. This is up 3.75 Wh up from Google's Nexus 7 equivalent and from our experiential tests, we found those figures to be fairly accurate if not a best case scenario. It will pretty much last you all day, but you'll still want to let it sip juice every night.
