Parking eye CCJ?????
Nvictoria
So, i got parking charge notice about a year and a half ago, got maybe 3-4 letters from them, the last one threatening with court actioning, as they do, still i didn't respond as i was advised to ignore. and I've heard nothing from them since.
anyway, i recently checked out my credit rating/history details, for unrelated reasons, (just to see what it was basically), and low and behold, theres an active CCJ in there, dated 9/2/16 for the amount £197 from the County Court Business Centre.
Now i don't know what to do, who do i contact? obviously i don't want it leaving on there for another 5 years?

Can you firstly delete the post you made on the other person's thread please (edit>delete). Stay on this thread as it is about your case alone.
Read the NEWBIES thread post #2 and all the info and links there about setting aside a CCJ.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

And you've had no letters from Money Claims Online or County Court Business Centre?
Have you moved house since the date of the alleged parking contravention?0 -
please list what letters you have received.
as above did you receive official court letters? From the Plain Language Commission:

I can't really remember exactly when i started receiving the letters, but i had maybe 3-4 parking charge notices, slightly increasing the price each time, then the price dropped to the original. the final one if i recall correctly was just after new year 2016?
This one looked bit scarier, county claim form, but after many hours googling and researching, the main consensus was to keep ignoring, as this was a "tactic" of theres to scare people into paying them.
Clearly, I made the wrong call, and am now left with a CCJ and a poor credit rating.0 -
can you purchase a link to the last one you received, as well add since of the sites that have you the consensus to ignore?
three is still a small chance the ccj can be set aside, although it wont be easyFrom the Plain Language Commission:

No way Jose! This one looked bit scarier, county claim form, but after many hours googling and researching, the main consensus was to keep ignoring
Seems more like wishful hoping! No parking (or other) forum that I've read has ever advised ignoring real court papers. Please do show us which ones you've read with this absurd advice. We need to put them straight.
You need to consider applying for a set aside. £255 to apply for one (£100 if you're on certain state benefits). But firstly you need to convince a judge that you have both a good reason why you ignored court papers (and what you've said above doesn't sound that great) and you have a reasonable prospect of defending the PPC's claim against you.
If you fail to convince the judge you lose the £255. If you fail to get it set aside at the hearing, you lose £255. If you get it set aside (and possibly then defend the original charge successfully or the PPC discontinues) the PPC may be ordered by the judge to refund your £255.
Here's some reading about the small claims court procedures and applying for a set aside. Read these as well as the NEWBIES sticky, post #2.

I'm sure that's a typo. I would read 'purchase' as 'provide'.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You've got a few options. They are outlined in the Newbies thread but I will do a quick summary.
First. Live with it. If you can live with a ccj it's an option.
Secondly apply for a set aside. This is a lottery. You may get one or you may not. Frankly ignoring everything doesn't help. You've been sent court papers and ignored them which courts don't like. In saying that if you believe you have a good defence it might be worth a try.
Thirdly if you are willing to pay you can ask for a set aside with consent. Essentially this involves you contacting PE and offering to pay as long as they agree to a set aside. Experience shows they nearly always agree as long as all their costs are met too.
IIRC option 2 costs £255 option 3 £100. Option 1 could cost £0 as PE don't seem to chase ccjs although this could change.
What you decide to do has to be your call as only you knows your circumstances.0 -
I'd hope by now after being signposted there, that the OP has read post #2 of the NEWBIES thread and knows the options for set aside. By all means query anything not clarified in that sticky thread and continue here to let us know how you get on.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
