    Hello all.

    Basically I am just wondering / advise / thought and opinion on the following.

    I would like to know how I can go about making a claim for loses / damage / criminal damage which is sometimes done to my vehicle when someone over takes me.

    The kind of damage I am talking about is the stone / gravel / debre which flys off from the persons tyres when over taking me and thus causes paint work damage / scratches / indentation and also windscreen damage / scratches on the glass / indentation marks.

    The evidence is caught via my dash cam. Overtaking can be seen and with audio can hear the clattering of stones / gravel / debre hitting my vehicle.

    Is it insurance job or solicitor or other ? Because frankly I am sick of it.

    I assume you never overtake someone or pass another vehicle yourself, including parked cars?
    Because if you do then you'll be doing the same to those cars.

    You need to be suing the Highways Agency or the Local Authority depending on who is in charge of road maintenance on that stretch.

    If you don't want your car to get damaged then put it in a garage and never take it out.

    Whats next, suing the gritter wagon in winter because it puts salt on the road which causes corrosion?

    The only place I ever get overtaken is on dual-carriageways or motorways, I can count on one hand the number of times ive been overtaken on "normal" roads in 20 years of driving, I would suggest that if your being overtaken that often, then your doing something wrong.

    I drive everywhere at the limit if the conditions allow it and from 30 to 60 zone (for example) I accelerate with enough haste to show the drivers behind that i'm doing the speed limits.

    I did once get my windscreen smashed by a truck that had a large rock stuck between it's rear wheels, can't exactly blame anyone but the rock.

    There are additional costs to running a vehicle that sometimes you have to bear:

    stonechips
    parking dings
    running over debris
    hitting animals
    nails/screws/punctures
    etc

    Some of them are preventable but it's life.

    Of course I am serious.

    It's the drivers who usually have powerful nippy cars. The ones who accelerate quickly, by ether over taking and throwing up debre as they drive over the middle white lines, that is exactly where gravel and debre is as that part of the road doesn't get sweaped or driven on much. Also drives who go in the right lane at traffic lights but instead of turning right they try accelerate and cut in front of me throwing up debre at my car.

    It is criminal damage, we all know that by over taking it is throwing up debre and causing some kind of damage, so yes it is intentional.

    As for parked cars, different issue, they should not park on road unless they have to, and if it's an issue they should not buy a property with No drive way.

    It's just the same situation as if someone is throwing a stone or other item at my vehicle to cause damage.

    Just find a "no win no fee" solicitor who will take it on, give them your dashcam evidence together with the estimates for repairs, and sit back.

    If a "no win no fee" solicitor will take it on, you have a case

    The main obstacle that I can see is proving which car caused which damage, once we accept that they are doing it deliberately, with malice aforethought.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))

    I think your claim is with the highway department it is their fault because they don't sweep the road at least twice a day, if they did this then there would be no debris to be thrown up by people who are overtaking legally
