The contractor, who owes the money, has admitted the debt on FB and has made promises to pay. Payment has not been forthcoming. The OP's friend, the subcontractor, has since moved abroad and therefore the OP is acting on behalf of his friend.
The OP has evidence that the work was done and evidence of the debt in the form of the FB posts. An invoice, with payment terms, has been sent.
OP, send a letter before action using the template in the posts above and then start a claim in the small claims court.
So where does his mate come into it?Originally Posted by shortcrust

You cannot act for somebody else in court - they must be present and they must speak for themselves. You can only be there for moral support - a MacKenzie friend.
And I am sorry to have to point this out, but "written in professional English" does not seem to be something that you are likely to be able to aspire to.
This is very simple - your mate needs to write to the person saying that he owes him £XXX for YYY work which he has been asked to pay. He has not paid. So he has 21 days to pay or else he will start court proceedings. It is that simple - it does not needs fancy words. There is advice here of what needs to be done if he doesn't pay - https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/609046/MCOL_Userguide_for_Claimants_April_2017.pdf
It is not clear whether the contractor is in the UK - if he is not then it will be difficult to make a claim unless there are assets in the UK.
Your mate should also note that you cannot serve legal notices via Facebook! He needs to write to him at his address, and the court will require an address to write to.0 -
Yes there is only one person0

Thanks Sangie,
The contractor is still in the uk and he is still working in the building industry.
My friend is the sub contractor which has now moved away but if court comes in place he will be back.
We have sent a overdue invoice to his email and his accountants email to pass on.
Next step will be address and the letter that he will start court proceedings..
Ps when I said about proffesional english i didnt mean that i would write a letter as im very bad when it comes to letters i was hoping someone could put something together on the forums ;d0 -
