Help can anyone tell me were i can get some

Self employed- sub contractor help

Ita about cash not being paid from contractor.

    Well, my mate a subcontractor which has now moved abroad and closed his self employement is owed a small amount (£400) from his boss (contractor) for the work he has complete.. Last time he has been to the job was on 19/01/2017 and that is the day that the payment was suppoused to be made, until now no payment has reached his account, he had previous transfers from this person for other work..

    I think the reason for non payment is because he moved and the contractor will not see him again. My friend was in touch with him on facebook chat and has asked for payment on many occasions, the contractor said he has no money but when he is back to the uk he is starting a new job so he will transfer some cash when client pays him, after a few weeks he states he has transfered the cash but when checked no funds have reached the account, so once again was back in touch and until now there was no answer what so ever...

    I have also pictures from previous job and i can ask for the two other employees to confirm i was there..
    I also had a good relationship with client if that helps..

    What can i do in this situation? I sent an overdue invoice with t&c payment to be made within 5 days

    I am confused. Who moved abroad? And is this you or a mate?

    As suggested previously, a letter before action and the county court - but if the person has moved abroad and has no assets in this country, then there is a real prospect you'll never see the money.

    My mate moved, and its my friend that has a problem. But im here and i want to act on his behalf

    It is perfectly clear. The OP has a friend, who did some subcontracting work. He was not paid for this work. The contractor, who owes the money, has admitted the debt on FB and has made promises to pay. Payment has not been forthcoming. The OP's friend, the subcontractor, has since moved abroad and therefore the OP is acting on behalf of his friend.

    The OP has evidence that the work was done and evidence of the debt in the form of the FB posts. An invoice, with payment terms, has been sent.

    OP, send a letter before action using the template in the posts above and then start a claim in the small claims court.

    Why would people be confirming that you were there, and your relationship with clients?

    Can your "mate" not write a letter himself?

    His english is not good enough when comes to writing, both contractor and subby are from poland. I think if written in proffesional english he might aswell be afraid and pay up.

    If he needs proof the other sub contractors can confirm he was there incase the contractor was to lie, and the job he was on the client was always at home so he can always explain the situation that he has not been paid and maybe the client can write a letter to confirm he was there...
