    And if he's caught driving otherwise in accordance he'll be charged with driving whilst disqualified.

    No, he'll be charged with driving otherwise than in accordance.

    No, he's disqualified until test passed. As soon as he drives otherwise in accordance he reverts back to being disqualified and that will be the charge v
