If you feel that the PPC has discriminated against you under the Equality Act, why not ask a judge to decide? I am sure that an LBA would quickly bring them to their senses.You never know how far you can go until you go too far.0

Anyone able to comment on what to expect nxt from PE, having lost my POPLA appeal & Procedural error complaint (as Assessor clearly didn't refer to, mention or consider my 33 points in "Comments on PE evidence"). Points essentially ignored by both Assessor's, favouring instead their own simpleton reasoning eg "signs are adequate". How does that, and PE horseshit evidence trump all my the time, hard work and precise rebuttals by appellants?. Feeling stitched up.
What can I be doing other than fuming & prepping for court case?0 -

Does that mean you asked and were knocked back or didn't you ask because of the witness statement?
It's not unknown for companies who seem unwilling actually be very helpful. It's possible Welcome Break have signed a contract saying they have to produce a witness statement if asked to do so. That doesn't mean they are unwilling to get it cancelled, it just means they have to give a witness statement.0 -

Some of these 'Witness Statements' can be somewhat 'dodgy', with some PPCs themselves actually signing the WS on behalf of the landowner. Sometimes dates don't make sense, sometimes they relate to a different location to the parking event.
Not saying yours does any of these, but worth checking out, and especially the bona fides of the signatory for Welcome Break.Please note, we are not a legal advice forum. Thanks for ideas folks. Welcome Break Business Development Manager signed the witness statement as 'Parking Assistant'.
I can ask, but in the face of such duplicity (ie a flexible & variable job title), compared to prepping for court, it is a longshot.
Of the 2 retailers i spoke to (bought food from both), neither Waitrose or Starbucks interested. Couldn't get past the very pleasant, but completely ineffectual reception staff.
I really want to stick it up PE and POPLA for this energy & time stealing nonsense. Hoping the Parliamentary committee on unfair parking practices will want a copy of the desperate generic PE 'evidence pack' that scored a win for PE. Doesn't help me, but might help in the bigger scheme. Not for nothing did they refer to PE as "Cowboy operators" back in March 20170 -
POPLA appeal felt like it would to lose a debating contest to a small child, who made no substantive points.
Wondering how complicit the parking operators and POPLA.
AND, if the only reason for successful appeals, is to comply with a pre-determined quota, and maintain an illusion of fairness/impartiality.0 -
POPLA is paid for by the BPA (which is paid for by the PPCs). The PPCs also pay POPLA for each appeal they challenge.Wondering how complicit the parking operators and POPLA.

If independent, they must have low evidential bar for PO'S, and much higher for Appellants, given what we see on this forum & elsewhere.
Popla accepted PE photos from 3+ yrs ago for my appeal, because I had not presented more recent ones. Erm, 400 mile round trip at great time & cash expense...0
