Hello again,
I have just received a 'Final notice' and email from Empark requesting immediate payment of the fine.
In the email they sent me, they say that they did reply to my appeal on the 12/01 (within the 35 days) and forwarded me an email trail as 'evidence'. They also sent me a photograph of my car and an attached letter confirming rejection of the appeal dated 12/01.
However, I did not receive said email (I have quadruple checked my inbox/junk/deleted), and the email trail they sent from the 12/01 did not include an email address (just my name) and did not have a content matter or any attachments - essentially a blank email with no recipient. So it seems they did not send the initial email properly?!
As such, I replied to the email telling them that, and confirming that the first response I received from them was today (29/03) and well beyond the required 35 days to reply to the appeal as stated by the BPA.
I am just a bit thrown off by the final notice and the threats to forward to debt collectors...etc. So I am a bit unsure as to what to do? Any advice?

Complain to the BPA, but I'm not sure you'll get much satisfaction, but at least you've stated your case. Tell the BPA that as there has been no provable response (put the reasons you've given above, plus copies of what Empark have sent you), within the 35 days, Empark have failed to comply with the Code of Practice, and should therefore now withdraw and cancel the charge.
Beyond that, just ignore anything that Empark send you, other than a LBC or MCOL Claim, but that won't happen:

If you get debt collector letters, those too should be ignored. Debt collectors are powerless, they can do nothing more than send you letters. See the NEWBIES FAQ sticky, post #4 which tells you how to deal with debt collectors.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
