    DEFINITELY obtain this in writing and dated and signed from the manager , also if he can state any issues with the machines or logging equipment and any similar issues they have had , you really need to get this as a witness statement including any correspondence between him and PE asking for a cancellation

    Do you think the court will be supplied with a full number plates list even though they only supplied me with partially visible ones? I am right in thinking we both have to have the same evidence, correct?

    Change the version I wrote to turn the tables and put PE to 'strict proof' of the VRNs updated at the same time as (list your two friends' car numberplates). That forces them to evidence it in court. They will have to show their cards, so to speak, and I don't think they will want to.

    Agreeing as well with the others - get the Hotel Manager to confirm in writing/email that he confirms you were a patron and that there must have been a minor key-pad error and that this happens often./sometimes, and that he asked ParkingEye to cancel the charge.
    They have now sent me the without prejudice letter by email which I am tempted to go for but after all your help (you guys are seriously amazing!!!) and the appalling way PE treat people i am tempted to go ahead, Any thoughts?

    I think they might discontinue once they see your WS and evidence. If it were me I would not pay them £60, I think they will pull out.

    Make life difficult by getting that email from the Hotel Manager even though he doesn't have a screenshot, he can at least confirm the position for you. And show us the amended wording of your WS, instead turning the tables on PE to put them to strict proof of the VRN entered at the same time as your friends input theirs (giving those VRNs).

    Would either of your colleagues be able to turn up with you for a hearing?

    Ideal if one/both can... if not I would still ask them for signed WS right now, urgently, to accompany your WS and to support your defence as it adds weight. Get them to include your VRN and their VRNs in their WS, and if they found the system cumbersome get them to say that as well as confirming they were never warned of any penalty for a typo or key failure...

  • Well after lots of to-ing and fro-ing the hotel wont back me up. They have told me to liaise with Parking Eye. So I have very reluctantly paid the fine :(

    Maybe you should now issue a Letter Before Claim against the hotel for your £60 back. Not sure what the legal basis would be, but I'm sure someone could come up with something. The hotel needs to feel the pain. Holiday Inn seem reluctant to get involved (in my experience), so they ought to suffer the consequences of getting into bed with the likes of PE.
