Probate & IHT Initial Questions

Hi there, as Ive said before, whether its because Im 'thick' or something?!..but Im not sure how to start my own seperate post?!
Anyway, Im a 81 yr old gentleman, who's older brother recently passed away. Now, there was no will, so Ive been told by friends that the estate/house, etc. will go to 'Probate'...
The problem here lies, my younger sister has somehow, taken it upon herself (as she had access to the deceased's house, bank accounts, money, etc.) to be the 'person whom is dealing with everything, etc. (including probate, solicitors, etc.) and even though I am the eldest brother, she is refusing to have me 'involved' whatsoever, and wont even speak to me to tell me whats going on, etc?
I found out the name of the solicitor she was using, but when I contacted said solicitor, they are refusing to tell me ANYTHING, as 'she' (my younger sister) is the 'client'!!
What can I do??!
I already know that she is selling/sold/gave away much of the actual personal property (from inside the house...) and not just do I believe that she is still taking money from at least one of his bank accounts, but she is also about to sell the house (possibly using one of these 'quick sale/48-hour sale firms' and I not only wont have a clue when, but as is obvious to everyone, I myself should be entitled to part of these proceeds/funds, yet she is taking it upon herself to deny me of this, and trying to keep all of the money, etc. for herself!
Please help me someone! I am only on a state pension, and therefore, certainly cant afford a solicitor of my own (unless they would act, then take their fees after the case is 'won'??!)
I was close to my brother, and yet even though me as the eldest wouldve wanted to have dealt with the probate, estate, etc. how the hell has she done this without my consent/knowledge??
ANY help would be GREATLY APPRECIATED!!0 -
I suggest you write immediately to the solicitor setting out your concerns and if you know the bank notify them of the death. The house cannot be sold with out first getting letters of administration. You can noify the Probate nOffice and issue a caveat that will prevent matters progressing. In the meantime go to your local CAB and ask for help.rogerdee1936 wrote: »Hi there, as Ive said before, whether its because Im 'thick' or something?!..but Im not sure how to start my own seperate post?!
