Unfair Parking Charge Notice from Parking Eye

Hello,
I recently received an unfair parking charge notice from the company parking eye for the car park on Seel Street, Liverpool.
I have read several other threads regarding this car park, as well as, the NEWBIES information. I have begun writing my response to their appeal using the advised template. However, I wondered if adding additional evidence would benefit or hinder my appeal.
This is because the driver parked during the night time and paid using the parking meter. The driver paid £3 and has 3 witnesses to confirm this.
However, upon receiving the PCN it has become apparent that the machine only processed 2 of the £1 coins placed in the machine by the driver who was not aware of this at the time due to the poorly lit car park.
Nevertheless, the driver has provided a ticket which confirms that money was paid (albeit it states that only £2 was paid, when actually it was £3.) The signs state that for a 1 hour stay the price is £1.50 and anything over an hour is £3. The driver left the car in the car park for an hour and 43 minutes.
Would it benefit or hinder my appeal to use the parking ticket as evidence?
Thanks in advance.

That's not going to help you in your appeal to PE, nor is it likely to persuade POPLA to adjudicate in your favour, unless you can argue a very good case that the machine was faulty.
Just send in the initial appeal (in blue text in the sticky) and in the meantime read up Section 3 from the sticky to help you start getting your head around what will win at POPLA, so you are ready to submit that in around 35 days after you send your appeal to PE.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thank you for your help!
Sorry, what is the sticky and how do you find section 3? Could you possibly send this in a link to me please?0 -

No link. That NEVER works well because newbies still have no clue how to use the forum properly and just return and ask for links to be spoon-fed at each appeal stage, which is no good for you or anyone.
The thread 'NEWBIES PLEASE READ THESE FAQS FIRST' was in capitals at the top when you instead just clicked 'new thread'. So please go back there and start again and read the FAQS first!
My signature below even tells you how easy it is to get back, one click.

I have read that I just didn't realise it was called a sticky.0

Nor did I when I first joined MSE all those years ago so I do understand. Now you know, on any forum, the permanent notices stuck at the top are called 'stickies' and they have the word 'sticky' on the left of the title and never drop down onto page two or further, like other threads do.
Here's a recent ParkingEye POPLA appeal won, not the same exactly but it includes some of the template appeal points lifted from post #3 of the NEWBIES thread:

Personally, I would add that the driver did pay the full £3 and has witnesses to prove it and the fault lies with the machine not registering (but swallowing and retaining) one of the £1 coins tendered.
Put them to strict proof of the coins unaccounted for that day - that'll be fun! Absolutely seriously, I really would add wording to put them to strict proof of that, but don't say who was driving, the appeal is done in the name of the recipient of the PCN and choose 'registered keeper' only in the appeal page drop-down menu.PRIVATE 'PCN'? Perhaps not, but it is grist for the mill in court, where it is the word of a fine upstanding member of the public against a company well known for dishonesty. You never know how far you can go until you go too far.0 -
It may not help you, but this carpark has a number of traps for the unwary motorist.
For example, the sign on entry states 'parking charges apply 6pm-8am' and your brain will process this as 6am-8pm (ie normal sort of parking period) if you arrive in the morning. It does not say18.00-00.00 and 00.01-08.00.
Carpark has attendant who you pay before leaving, so you may not bother to read signs, and if you return after he goes at 6pm then you cannot pay at machine as the signage 'clearly' states an evening tariff applies. It will not let you pay what you owed attendant ie the £1.50/hr on the hand painted sign at the street corner.
Or, you may arrive at midnight and see the hand painted sign in the dim light and assume it is free. Or your MK1 eyeball may be able to read the signs but you mistakenly put in a letter O instead of a zero for your registration. This error generates a PCN as the terms and conditions 'clearly' state in small print, with zero white space and partly obscured by the parking meter that this is so.
One could begin to think that this car park has been designed to generate fines. I hope you parked completely within the parking lines in an unlit car park as you agreed to in the terms and conditions.0
