ES Parking Ltd Evidence

Hello,
I'm about to submit my first defence for an invoice from ES Parking Ltd where my husband got a ticket for 'not parked correctly within the markings of the bay or space' we appealed, which was turned down for the following reasons:
'Photographic evidence shows you did not park correctly inside a marked bay and or caused an obstruction'
My husband has a long wheel based transit which is longer than your average car but was parked with the bay, there are no marking infant of the car parking space, he'd park din that car park on numerous occasions and there are no larger spaces for such vehicles.

We've got some defence together, how much needs sending to MCOL at this stage?
I've been following the amazing win from someone on here but the circumstances are slightly different.

Any information would be gladly received. Thanks

You need to tell us exactly where in the process you are - You mention of MCOL makes things quite unclear? Have you exhausted the appeal process/failed to engage with the PPC until now?

And that defence won't cut it with any PPC - They don't do facts/mittigation You need to read the Newbies Sticky at the top of this forum to learn the strategies that do work.

Ah ha, i didn't see that, sorry, i'm reading so much info it's making my head hurt.
I'll read through that and then post my defence, thank you.

Do you mean appeal, or court defence?

If this is a recent PCN and merely being appealed then read the NEWBIES thread post #1 where the template appeal for IPC firms is all you need (anything you say will be rejected by any such cowboys (that word is quoted from a Parliamentary debate on this sort of scam, only last month).

Delete real names and anything that can identify the defendant such as PCN number, reg numbers etcetera.

    DO IT NOW!

No, it is too short. The Inadequate Signage template appeal point in post 3 of the NEWBIES on its own is longer than the whole of your appeal.

Where has the appeal (or is it a county court defence) gone? It's not clear, still, at what stage this is.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • It was the court defence, but i got it checked over yesterday and made some amendments.

It wouldn't allow me to submit it in the 120 lines last night and kept crashing, so i emailed it. Sorry for the lack of clarity, i've been a bit overwhelmed with information and trying to submit it for today. There was a recent winning case on here, the woman was so lovely at helping me see what i needed to do and giving me advice.

The file is getting thicker if it goes to court.
