  • I gave them 14 days to reply, I sent a letter and I even text the letter to him but he will just ignore it, I sent another letter which he refused to sign for and it's now been sat at his local delivery office for 10 days.

The LBA was sent on the 9th April but I haven't heard anything from them, I have emailed him etc without any response.

In which case I would personally leave it until about the 3rd May and if nothing has been heard, start a claim.

Reason I would leave it until about the 3rd, is because I would give them 14 working days, and what with Easter etc. Although it seems a pretty open and shut case, always want to look reasonable to the court!

Although, how did you pay? Debit card, Credit card etc?
  • Thank you for the advice! I don't want to seem to be going absolute bonkers but those sofas do not match what I ordered do they?

Also, is my POC okay for when the time comes to open a claim?

Personally I think they look pretty much the same - maybe the leather part looks darker in your picture, but its hard to tell looking at the small pics.

    How did you pay?
  • I was quite stupid with how I paid, it was paid via bank transfer.

I would add much bigger photos but I am not allowed to upload files on to here at the moment.

Ah well, we all live and learn! Next time always try and stick purchases over £100 on a credit card as it offers you a lot of protection.

POC looks good to me. Short, to the point and covers all the facts.
  • I have added two new photos on the 'LegalBeagles' forum.

Nobody can upload photos here. Anyone who wants to link a photo needs to upload it to a hosting site (photobucket, tinypic, imgur etc.) and then post a link in a reply here.

Until you have enough posts then you can't post working links ... so post broken links ... change http to hxxp :)

What is the seller's explanation for the £109.00 discrepancy?
I haven't heard an official reason but I can only assume it's for the return costs.
You need to find out the reason why they have withheld £109.

If they have withheld money because, for example, they think you have damaged the returned goods, you have an entirely different battle on your hands.
