There is a 3 step process for an English creditor to have a CCJ enforced in Scotland.
It involves the paying of a fee, similar to set aside, you may find that because of the low amount of debt involved here, spending more money on recovery won't be appealing to them, so you may find this judgement is not chased up.

It is in fact extremely easy to order heating oil with no proof of who you are, they will also just open the tank and supply the oil with no one present. I did not come here to be called a liar, it is extremely easy for me to prove I did not order the oil given I have the tenancy agreement with name of tenant at property the delivery was made, however, due to circumstances I would prefer not to go down the route of fraud etc. Just for info the company was Carrs Billington under JWF.

And yes I know I would have to contact the court to find details of the CCJ, this was the easy part and I have been in contact with Count Court Money Claims Centre.

Thank you to everyone for your advice and help, it is much appreciated.

Is that in regards to me? I never called you a liar - just explained that the oil company would not buy it because if they did - everyone would simply say that it was someone else. No need to get defensive about it, it's just reality that they hear stories like that every day, and they all weight to zilch if you didn't follow up with police/court yourself.
  • Have you tried calling the police and getting a crime number- you may be asked this later on?
It would also help you prove your case.

As things stand it may appear the tenant obtained goods (oil) by fraudulent means
    baldly going on...

The English pursuer would have to raise an action in the OPs local Sheriff Court - any English County Court simply lacks jurisdiction.

Would appear to be a default judgement.
