  • We would.move if we could but we can't afford the £2000-2500 we need upfront because the rent is now out of our price range. Already stressing about the costs have told council etc we can't pay it so we are going to end up with a CCJ unless they take instalments.

    If you have made an approach to your local authority under the current homeless legislation, they should be offering you alternative accommodation on the expiry of the S21, rather than waiting for the landlord to take further action (with the attendant costs involved). How open your LA are about that obligation will depend on where you live and the housing market in that area.

    They are not offering us anything, just saying to keep bidding on houses as they come up & until the baliffs come knocking then they will help us if we haven't been successful in bidding for a house.

    Very judgemental of you,do you get a kick out of being so judgemental. You know nothing about our situation & it's none of your buisness weather we are on benifits or if we work, but FYI my husband works full time & I am a full time carer for my 16 year old autistic son who hasn't been in education for 6 months.

    The LA are OBLIGED to provide you with temp at the end of the S21 notice period if your landlord has indicated an intention to go through the court to gain possession. This obligation is contained within the Code of Guidance and was further re-enforced in a letter sent to all LA's by the then housing minister, Brandon Lewis, in March last year. It might be wise to contact either Shelter or your local solicitor who deals with housing issues.

    It's also worth bearing in mind that LA's can now discharge any homeless duty by making an offer of a privately rented property, so homelessness is no longer the foolproof route into social housing it once was.

    Hardly helpful regarding the topic of this thread. Perhaps, if you have an issue with the SOA, you could comment on that thread?

    Why have I put a SOA up.....because we are in debt so NO we cannot afford the upfront costs. My youngest son gets DLA that is HIS money which is used to replace anything he breaks when he has a meltdown (Very Violent) clothes for him....if there is anything left it is put away for him because it is his money!! In reality most of that money is child tax credits, DLA, maintence, some Housing benifit and the fast majority of tht will stop in the next year or so....so we are looking to the future because when I do go back to work I won't be able to earn enough to cover what we will loose becasue I will still need a job that is term time because when my youngest goes to residential college he will still need 24/7 care when he comes home.

    It's really difficult dealing with an autistic child, and he sounds like really quite a handful!

    You asked what you should do, and there's no easy answer. You are in a difficult position, with quite a lot of debt at very, very high interest rates. I think you should concentrate on that and just accept that you will get some sort of accommodation offer from the council eventually.

    I suggest you speak to one of the debt charities for help on that, and maybe consider bankruptcy or some other option so you're not running up an interest bill of over £500 a month. The debt is what's preventing you moving on to a new home without help from the council.
