Hi all. I am a resident in a block and been renting and regularly paying for a parking bay for over 5 years. The management company of the flats (who takes my flat's rent + parking bay rent) never sent any permit for years and I would park. Sometimes when I am gone on my car, my wife used to park her car. (We live together at the same address). Last month Ace security issued tickets to both our cars while she parked behind my car and I was about to go in a while. And then we found tickets on both cars. I appealed to Ace for my car explaining that I rent and pay for the space for years and no permit was sent. They replied to contact the management company as Ace is not responsible for sending them out. I contacted management company & they said all tickets will be cancelled. I particularly explained my wife's car ticket and I was told it's fine to park her car as long as I am renting the space. Today, we received a Notice To Keeper on my wife's car telling to pay or the costs will go up with letter from solicitor. They never sent NTK for my car (even hough they put 5 tickets on my car & I have ignored them all after regularly informing the management company ). Need advice please on how to deal with NTK for my wife's car. Many thanks.

Nasty firm for the MA to let loose near your cars. They sue people and there is NO appeal worth trying (don't pay them though). Send the usual IPC version (from the NEWBIES thread) appeal in the name of the registered keeper named on the NTK, adding that the Managing Agents have cancelled this PCN already. Do not name the driver - see the sticky thread 'NEWBIES PLEASE READ THESE FAQS FIRST'.
At the same time as appealing (pointlessly) I would go back to the MA with that NTK (give them a copy and keep the original) and insist this one is cancelled as promised - check they are all cancelled - and state, how DARE they allow this notorious ex-clamper bunch marauding around your cars on site?!
I would then follow that up with an email or letter to the MA (keep a copy for YEARS) declaring that at no time has any 'parking charge' risk been part of the terms of your tenancy or of your parking space rental, that you have parked and enjoyed peaceful enjoyment of that space for 5 years and new terms cannot be bolted on or the rental unilaterally varied now.
State that you do NOT accept any risk or liability for any 'parking charge' (only the rent you pay for that space, no other charges) and that this recent change is not acceptable and appears to be a blatant disregard for your rights and easements as the tenant who pays for the space. State that, for the avoidance of doubt, you hereby opt that space OUT of the 'Ace'(PACE) regime and they must take formal note that you never agreed to any terms at all beyond those already signed/agreed and granted years ago.
Remind the MA that they are agents of the landowner who remains liable for their conduct and this is a matter of derogation from grant and unwarranted trespass in your demised space, which they MUST cease and desist immediately.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
