Urgent help please

Hi all, so I'm in a bit of a situation. I'll try and time line it, and any help anyone can offer would be massively appreciated.

July 2016 I parked on aviator way Manchester, in a Regis car park whilst waiting to pick people up. It was around 8pm at night and the car park was empty so I thought nothing of it.

September 2016 I move out of my old address

Fast forward to April 2017 and I found out yesterday via a Experian credit check that I have ccj dated against me, on march 20th 2017 for my old address.

The ccj relates to where I parked in July. I've not had any correspondence to challenge anything so now I'm faced with have a ccj against me. I accept me moving may have resulted in the correspondence gong a miss but we did all we could. Updated dvla redirected post etc....

I found out today that the people trying to inforce the ccj are represented by Gladstone and called uk parking and enforcement.

Any advice on next steps? Do I just pay to have it set aside then challenge through the courts or do I just pay the jcc and avoid it sitting on my credit score (still within the first month) I need to move quick on this so any help is much appreciated :) thank you.

    These are your options
Option 1: pay it off, this will result in the CCJ being on your credit file for 6 years, while it will show as satisfied it still has the potential to cause issues in the future

Option 2, ignore, as above but with the added risk of enforcement action

Option 3: set aside and a fresh hearing, this is probabaly your best option, however you must not identify the driver do not use any terms such as I parked, I drove/He drove she drove etc

Forum searches here and on PePiPoo on 'Gladstones set aside' should turn up other cases to learn from. Also these links might help you understand the process you need to go through.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Sounds like the basis to set aside is that dvla were notified and, coincidentally, updated their system only after providing an old address to the parking Co.

Dvla will provide the date of the data request that can then be married up with your change of address notifications.
