So i just opened the door to my new house.

So i just opened the door to my new house (at 15:00) after completing today at 11:30.
The key wouldnt open the door, it wouldnt even turn, weird, i checked the handle and the door was open. I pushed it open and before me stood the woman i was buying off of still packing with her friend. The house was an utter tip, the walls were a mess where things had been taken off and there was junk everywhere, nowhere near being done. She had the wrong end of the stick and thought she had til friday to finish.... Shes told me she wont have everything out the house until saturday as her bed is attached to a wall and the only person who can dissasemble it without !!!!ing it up has to remove it. So she also has to keep a key... I dont know what to do, ive just drove back to my parents house but in essence, im paying for the mortgage, and council tax today but i wont take meter readings until shes out. Is there legal problems with this?

i will note that she paid/agreed with people to help who didnt show up.

also to note she is a really nice lady who has autism and i dont want to mess her over but i did expect id be able to get into my own house after i paid for it.

  • I thought the phrase was 'vacant possession' before completion could happen? Contact your solicitor for guidance.

    I would move in, take all my clothes off and start throwing all her cr*p into the street

    She hasn't given vacant possession on completion. She is liable for all your reasonable costs.

    Accommodation.
    Storage of your property.
    Additional removals costs.

    You need to speak to your solicitor, who will grumble at her solicitor, who will read her the riot act. Keep the moral highground, because the law is on your side.

    Contact your solicitor now and get them to contact the buyers solicitor.


    No matter how nice she is, she is in breach of contract by not providing vacant possession. Keep a track of and receipts for any additional costs you have incurred from the delay.

    I had this done to me when I purchased my first house. I spoke to my solicitor who in effect said that as it was literally for a couple of days (which it did turn out to be) it was pointless taking legal action. Although in my case I still had access to my previous property so wasn't homeless(I was moving from rented). If you were, you could claim for the breach and associated losses. E.g hotel and storage of your items.

    In my case it turned out they were using the extra days to plunder the house of all the fixtures AND fittings they said they were leaving on the property info pack. Still gets on my nerves 15 years later.

  • and do all of these things now, or it wont happen until tuesday, but given the time your solicitor has probably finished early so you might be screwed.

    Really not your problem.
    Is it the actual former owner of the house or a tenant?
