Does anyone know if my ex-partner and I made Wills out in favour of the other in the event of either of our deaths that it would qualify as proof of an Express Trust agreement?

We did this when our intentions were totally bound up in the family and assets we'd created. I now have a situation where my other half is saying that because the property is in her sole name, she get's to keep the house.

This was NOT our true intention at the time. (See my previous post on this.)

If so, this would be far easier than going down the TOLATA route of Implied/Constructive Trust in the courts, which I would obviously prefer to avoid, but it looks as though unless I do send a lawyers letter, it will not be taken seriously.
