Deadlines for parking fines - Bloom Street Manchester ParkingEye

Hi Everyone,

I just wanted to thank everyone in advance for your help. I've been reading a lot of threads from different websites and I'm very confused with regards to the deadlines we have to adhere to so any help would be much appreciated.

Here's the background:

My husband parked a car registered in my name in a car park monitored by Parking Eye on the 28th February 2017. He did not receive a PCN on the windscreen of the car on that day. Instead I received a NTK on the 5th April 2017.

Here are some details from the letter itself:

Date of event: 28/02/2017
Date Issued: 04/03/2017
Date: 04/03/2017

Parking charge amount due: £100.00
Payment to be made within 28 days of date issued: 01/04/2017
This parking charge is discounted to £60 if paid within 14 days of the date issued: 18/03/2017. After this date, the full parking charge amount will be owed.

I didn't get the NTK before the 14 days so my appeal was going to be that the NTK is incorrect and that it failed to meet the obligations of Schedule 4 of the POFA Act 2012. Am I right? Did it fail to meet the obligations? I looked on the envelope and there is no post mark so I'm struggling to prove that I received it on the 5th April 2017. Also I received it after both the 18/03/2017 (if I wanted to pay the reduced cost which I won't) and the 28 day deadline of 1st April 2017. I'm happy to go to court if needs be but as I'm pregnant I'd like this matter to be resolved ASAP,

Anyway much help needed to untangle this mess.

    your posting is confusing

at the top "Instead I received a NTK on the 5th April 2017."

further down "Also I received it after both the 18/03/2017 "

what date did you recieve a NTK thru the post ?

also before shooting off looking for technicalities that might not exist please read https://forums.moneysavingexpert.com/discussion/4816822

    all will be explained

I don't think it is confusing, it's very clear and concise. The OP is just quoting the 18th March as the 14th day after the event.

OP, yes read and act on the sticky thread but I'd also be writing to the DVLA and asking when your keeper details were accessed by Parking Eye. If it is after the 4th March then that is clear evidence that they have back dated the NTK that they have sent to you.

the period between those two dates exceeds 14 days , IF the vehicle is owned by the OP (not leased/hired) or the OP has not changed address , the V5 is in the correct name/address then PE have exceeded tho time to rely on POFa

perhaps the OP can check and advise the above , before going further?

Did you miss the part where the OP has stated that the NTK although received on 5th April 2017 is dated 4th March 2017?

NO I did not miss it ,

I asked about ownership of the car before going off worrying about delayed post , the letter could have been put in an envelope and fowarded by a lease Co for all we know .

if the ownership is correct ,then PE will claim it was posted and "deemed" to be delivered within 2 working days , HOWEVER that is by RM , not UK mail

Yes it could have, but I get the impression from the OP's well constructed and concise opening post they'd have mentioned such a key point.

Yes, of course they will, but the OP has already grasped that point and highlighted their difficulty (without a postal frank) in proving when the NTK was received. Thus my suggestion they find out when keeper details were accessed by PE.

Never mind the dates, is it a blank space (non POFA) one as per the linked example in post #3 of the NEWBIES thread? Is it like that, or a POFA '29 days keeper liability' worded one?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you all for your replies. I have read the sticky thread.

Pappa golf: I received the NTK on the 5th April 2017.

Johno100: I will get in touch with the DVLA regarding when my details were accessed.

Pappa golf: I do indeed own the vehicle. Always has been registered at my current address.

Coupon-m: unfortunately my letter is one that mentions POFA 2012.

So going forward my actions are to:

    1. Get in touch with the DVLA regarding when my details were accessed

    2. Do I get in touch with ParkingEye to say I contest the PCN yet as I've been researching and haven't replied to the original NTK

    3. I've just come home to find I've got a reminder. Any advice on what to do going forward?

Just got in touch with the DVLA to ask when ParkingEye accessed my information and they've asked me to fill in a V888 and provide proof of ID to request the information. It will take 2-4 weeks. Before I proceed are you aware if this is the correct form?

As the Registered Keeper of the above VRM could you advise who has accessed my personal details with regards to this marque, how often and when did the DVLA send the keeper details out. Please advise the information with regards to events between xx/xx/xx/ and xx/xx/xx.

I understand there is no charge for this information and look forward to your speedy reply.

    Yours faithfully

v888 is for paying customers , you are not asking for info about another car (v888) you want details about YOUR car
