  • Thank you and yes it is that car park!

It's so hard as I have searched the appeals on here for this car park and this was the most recent I could find, unless I am going completely blind??? Can anyone help me please?

I searched the single word 'Canvey' as I recall this car park and have seen photos of it:

    https://forums.moneysavingexpert.com/discussion/5333380

That one is a little old but it covers the fact the photos show the car outside the car park boundary (barrier) and that the driver may have stopped to read the signs and to consider whether to even enter, seeing as the signs are not clear, the one at the barrier is not the same as the ones inside, and the car park is so potholed it's not somewhere any driver would have happily driven stright in and parked up.

It's not hard to put together a POPLA appeal even if you had not been shown that one (and beware, it's old, not perfect now). All you need to do is use the template POPLA appeal points pre-written for people. Post #3 of the NEWBIES thread.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thanks Coupon Mad that is actually one of the searches where I found something I just meant it seems so long and complicated to draft one as you guys suggest. Having to read through so much when I am so busy with other stuff right now. A clear template that I can amend and/or delete/add to would be so much simpler.

I will do my best and repost again when I can find the time!

You ought to try reading through (and replying to) dozens and dozens of sometimes very complicated threads 24/7/365 when most regulars also have very busy lives. Our major contributor, Coupon-mad, has a full-time job and 4 children, and she's up until 1am - 2am most nights of the week helping others with their problems.

Were life oh so simple! Looks like we've got to do better folks!

@OP - don't you consider other recent winning ParkingEye : POPLA appeals provide everything you ask for here?

  • I wasnt having a go or anything - defo not trying to belittle others who work hard on here!! i just was being honest with my thoughts on it - surely we are allowed to on this forum? :-)
  • I have over 20 years work experience, am studying for a degree whilst I too work full-time with busy family life as well. Just because i am not an expert on this forum, doesnt mean I cannot have a moan about the long drawn out process of appealing a pesky parking fine! It wasnt anything personal against anybody on here at all - sorry if people felt it was.

  • Oh for goodness sake! I wasnt talking about anything personal against the people that set up this forum and help give others advice, why does my thread now have to be about that....I just wish there was an easier way to get rid of these stupid parking fines and to appeal via POPLA, it feels like I (and all of us, I wasnt just selfishly referring to myself as you are suggesting here!) have to go through so much material just to write out the perfect appeal response, when these companies like Parking Eye should surely just be told to do one! lol

I think you are misdirecting your frustration about this towards the forum (or that's how it looks to me).

Barry Beavis tried to tell PE to 'do one'. Unfortunately the highest court in this land - The Supreme Court' - failed to support him, effectively telling Barry to 'do one' and cough up the PE PCN. But that's not a reason for you to 'cave'.

None of this stuff is simple. While you might believe it should be - and I wish it was, because our simple advice to every newbie would be 'tell the PPC to do one' - but unfortunately you're into legal territory and PPCs know that being told to 'do one' will auger well for them once they issue court proceedings. And PE are the most litigious PPC in the land, issuing 25,000 court papers a year.

We are encouraging you to put together a comprehensive POPLA appeal, based on recent appeals where PE have 'caved' frequently, so as to avoid PE suing you, where the effort to defend will make the research work required for a POPLA appeal pale into insignificance by comparison.

  • thank you! And sorry for my frustrations (which arent directed at anybody intentionally) - its all too much and I just wanted the nearby pub to cancel the ticket for me but I have heard nothing from them which means I now have to pull my finger out and do this laborious appeal thing.

Thanks again! I will post my amended response in due course :-)
