Second PCN after midnight?

Hello everyone,

I received a PCN in the post from Indigo/ZZPS because of a parking infraction at Brighton Station in March. I parked at around 6pm and left at 01:28am. I paid the fine because I didn't pay to park (I was rushing to get my train...yes yes, should have paid, I know!) and believed it to be a valid fine.

They then sent me a further letter about 3 weeks later stating that as I hadn't paid, I had to pay the full fine plus fees. I queried this, and they have informed me that this is a second PCN that was generated because I stayed until after midnight and the infraction occurred over two calendar dates.

There was never any mention of this in their original letter, and I have since discovered that Indigo aren't exactly reputable. Are they just chancing their hand because I paid the first one? Or are they legally correct that they can issue a second PCN after midnight?

Any advice gratefully received!

    There is no 'legally correct' about it, this is a private firm making it up as they go along. There's no law about it.

    So, have they sent you a POPLA code? If not, email back and demand one.

    You will win by following other Indigo POPLA appeals from here. But you need a POPLA code in an appeal rejection letter so have you got one? If not, get it by insisting.

    Finally, if you are Brighton based you are in my neck of the woods - so don't fall for this again, I hoped Brighton people were more canny about scams in general - I am here to advise on these 'PCNs' and no-one pays them!

    A lot of them issue charges per day, so it's presumably rolled over at midnight.

    It's no more valid for it though, just it means that potentially they did issue you 2 invoices.

    Presumably these invoices came in the post, and whilst you paid the first one, you've followed the forum guidelines for the 2nd one?

    If it was via the post, I'd issue a Letter Before Claim asking for the money on the first one back, and compensation for the Data Protection Breach caused by then accessing your details from the DVLA without a valid reason. I'd also check with the DVLA that they accessed (and paid for) your details twice - once per invoice.
