Return & Refund Doubts

Hi I'm looking for advice,

Bought a £11000 caravan from suppose reputable dealer 940 mile round trip with credit card

Next day when home it was not as described or fit for purpose

Contacted my bank 2 days later to try & stop transaction which failed

Phoned seller and he told me to return caravan for full refund

Returned caravan 940miles round trip as advised only to be told “your not getting your money back, you can take me to court” (the dealer & his team was very intimidating and it seemed that they were trying to provoke a reaction out of me)

Telephoned the bank from dealers premises ….bank advised me to take the caravan home again and NOT to leave it with them...

Following day contacted C.A.B. And after following their advise ….plus having an independent report taken on the caravan which when completed showed many more problems...

Anyway much more than this but it seems to have worked as I have received registered mail saying he will give full refund plus £200 as a good will gesture for expenses to return the caravan....

I don't trust this man's word so should I return the caravan again at another 940 miles round trip and if so and he then again refuses what other options do I have???

    What do you mean" next day it was not fit for purpose" .......
    Also, what did the reviews say about them, did you check them out?
    Is it a limited company?
    The caravan may have had faults , but how was it described.

    Start by reading MSE's Section 75 Refunds article.

    In there you will see that your credit provider are equally responsible for the contract.

    Perhaps have a discussion with your card issuer suggesting that you are going to return the caravan, in line with the seller's latest letter, and if the promised refund (plus travelling expenses) does not materialise, you will be looking to the card issuer to pay instead.

    Seems you need to speak to a solicitor .
  • hi hollydays for a start they stated under 10% damp when in fact its 38% also cigarette burns plus pet hairs found.. not really fit for an asthma sufferer plus much more ....but that isn't my dilemma on here. I'm asking what option do i have if he refuses when i get down there..

    Cigarette burns plus dog hair? How is this not fit for purpose?
    How did they hide these?
    Did they state the damp readings in writing?
    If you've got no legal recourse, it's pointless returning it.

    To the op:

    I suggest you go down the route suggested in post number 3. You are entitled to hold the credit card company liable. The link explains some of the advantages of doing so.

    If you are unhappy with the credit card company's proposed remedy then you can complain to them and ultimately to the Financial Ombudsman Service, which costs you nothing but time and effort.

    If after all that you are still not satisfied you can then take legal action against either (at your choice) the credit card company or the dealer. However if you even start legal action you cannot take the matter to the FOS. (So if you go first via the cc company, then FOS, then legal action then you get an extra bite of the cherry.)
