Wrong location on NTK

I recently received a NTK for the wrong location, where do I stand?
I've drafted a letter letting them know that I have never parked in that car park nor has anybody else who I've given permission to drive my car. I've also stated that I'll counterclaim should they pursue me for this and further communication will be considered harassment and reported to the police.
Surely by the time they get my response it will be too late for them to discover their mistake and send a corrected NTK, especially as I'll delay sending my reply until the last few days.
Seems like the clowns running these firms are either stupid or so inundated with letters to write and send out mistakes are being made.

Only make threats that you are prepared to carry out. Otherwise your threats are as hollow as those issued by the PPCs and their debt collectors.FormalSmirk wrote: »I've drafted a letter letting them know that I have never parked in that car park nor has anybody else who I've given permission to drive my car. Yes, which is why you must be sure not to reveal who the driver was, or give them any clue (so don't say "I or any other person..."), they could make inferences.FormalSmirk wrote: »Surely by the time they get my response it will be too late for them to discover their mistake and send a corrected NTK, especially as I'll delay sending my reply until the last few days.
Keep your challenge simple and short, no ranting. State simply that the vehicle was never at the location specified, and therefore the charge must be cancelled.
How "wrong" was the location? Was it completely wrong, or just a typo or using something like "street" instead of "road"? Don't give the exact location here.0 -
I'm more than happy to go through with my threats, I've had to put my own cases to county courts for valid contracts. I know judges don't just order defendants to pay up even in these cases.
It's very wrong, completely different street and postcode.
Its a good 10-15min walk.0 -
Drafted or sent ?
Why shoot yourself in the foot ?
They will need some evidence you parked here, tip them off and they will just send a new NTK for the correct car park.
Calm down and start thinking straight.I do Contracts, all day every day.0 -
Drafted.
But they can't send a new NTK within the 56 days, unless they have access to a time machine.
Correcting the NTK makes them look stupid, although so does sending a wrong one.
If I ignore it, it looks bad should it go to court.
What do you think I should do?0 -
If you did not park where they said and they have no proof, then treat it as junk mail, along with all the other junk mail scams.
They will need some proof if they try court.
Judges dont do "looks bad" they do cold hard facts.I do Contracts, all day every day.0 -
They have written to me again before giving me the 28 days to reply.
Should I go to the police with this?
In the new letter it states that 28 days have lapsed, but they haven't.0 -
Not unless you want to be laughed at! This is nothing to do with the Police.Should I go to the police with this?
You haven't said which PPC it is nor what they wrote, nor whether they've reissued the NTK.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The relevant case for harassment is Fergusson v British gas. It takes a pattern of correspondence (and your written requests for them to desist) before you can properly evidence harassment - which can be both civil and criminal.0

Should I go to the police with this?
This is a long way from criminal harassment, calm down.
If you want to complain, do so to your local Trading Standards Department in writing. You never know how far you can go until you go too far.0
