2. HMRC will just take it from the next claim, as an overpayment. Much easier than chasing someone who's moved on.
They don't recover joint claim overpayments from single claims nor the reverse.
They MAY recover OPs half from her future claim, but that is not the question she asked.
It absolutely is a scare story as OP will not have to pay more than half the debt. You're telling her she has to pay the whole amount.0 -
Nope, you are both jointly liable for the whole amount.
They'll take it from the easiest source, which will be you.
That's not what gov.uk say.
If you claimed tax credits as a couple
The debt will be split in half between you. Each of you will receive a letter with details of your half of the debt. You must each pay your half.
Contact HMRC if you think your share is wrong.
